The Local Government, Planning and Land Act 1980 (Amendment of Schedule 16) (England) Order 2011

Laid before Parliament: 8th June 2011

Coming into force: 30th June 2011

Pursuant to section 93(4) of the Act, the Secretary of State has sent written notification that he proposes to make this Order to each of the bodies to whom Part X of the Act will apply by virtue of the Order and, as required by section 93(6) of the Act, a period of 42 days from the date of that notification has expired.

Citation, commencement and application

• (1) This Order may be cited as the Local Government, Planning and Land Act 1980 (Amendment of Schedule 16) (England) Order 2011 and shall come into force on 30th June 2011.

• (2) This Order applies in relation to land in England only.

Amendments

Schedule 16 (Bodies to whom Part X applies) to the Act is amended as follows—

• (a) after paragraph 5BZB insert—

(5BZC) The Greater London Authority.

• (b) after paragraph 5BB insert—

(5BC) Transport for London.

, and

• (c) after paragraph 5CC insert—

(5CD) The British Transport Police.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order amends Schedule 16 to the Local Government, Planning and Land Act 1980 Act (“the Act”) by adding the Greater London Authority, Transport for London and the British Transport Police to the list of Bodies to whom Part X of the Act applies.

Bodies listed in Schedule 16 to the Act are those to which the Secretary of State’s powers in Part X of the Act apply. Those powers enable the Secretary of State to direct bodies to take steps to dispose of unused or underused land held by them, subject to certain procedural requirements set out in the Act.

An impact assessment has not been prepared for this instrument as it has no significant impact on the private or voluntary sectors.

[^f00001]: 1980 c.65. The functions of the Secretary of State under section 93 are, so far as exercisable in relation to Wales, vested in the Welsh Ministers. Those functions were transferred to the National Assembly for Wales constituted by the Government of Wales Act 1998 (c. 38) by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), article 2, Schedule 1. By virtue of paragraphs 30 and 32 of Schedule 11 to the Government of Wales Act 2006 (c.32), they were transferred to the Welsh Ministers immediately after the end of the initial period as defined by section 161(5) of that Act.
