The Calibration of Tanks of Vessels (EEC Requirements) (Revocation) Regulations 2011

The Secretary of State makes these Regulations in exercise of the powers conferred by that section.

Citation and Commencement

These Regulations may be cited as the Calibration of Tanks of Vessels (EEC Requirements) (Revocation) Regulations 2011 and shall come into force on 1st July 2011.

Revocations

The following Regulations are revoked—

• (a) the Calibration of Tanks of Vessels (EEC Requirements) Regulations 1975[^f00003] (“the 1975 Regulations”);

• (b) regulation 2 of the EEC Requirements (Amendment) Regulations 1985; and

• (c) regulation 3 of the Measuring Instruments (EEC Requirements) (Amendment) Regulations 1988.

EXPLANATORY NOTE

These Regulations implement Directive 2011/17/EU of the European Parliament and of the Council of 9th March 2011 repealing Council Directives 71/317/EEC, 71/347/EEC, 71/349/EEC, 74/148/EEC, 75/33/EEC, 76/765EEC, 76/766/EEC and 86/217/EEC regarding metrology (OJ L 71 18.3.2001 p 1) insofar as it relates to the repeal of Council Directive 71/349/EEC of 12th October 1971 on the approximation of the laws of the Member States relating to the calibration of the tanks of vessels (OJ L 239, 25.10.1971 p 15, (OJ/SE 1971 1st Series Vol III, p 865)).

The Calibration of Tanks of Vessels (EEC Requirements) Regulations 1975 (“the 1975 Regulations”) implemented Council Directive 71/349/EEC which has been repealed.

The 1975 Regulations provided an opportunity for UK manufacturers to make an application to the Secretary of State for EEC Calibration of any tank of a vessel. The application was to be made in a prescribed form and for a prescribed fee. The Regulations also provided that after a calibration of the tank, the Secretary of State should issue a calibration certificate, to be affixed on the calibrated tank. The 1975 Regulations provided for the circumstances under which such certification would cease to be valid. The 1975 Regulations further provided for the offences and penalties in connection with the misuse of a sealing mark.
