The Local Democracy, Economic Development and Construction Act 2009 (Commencement No. 2) (England) Order 2011

The Secretary of State, in exercise of the power conferred by section 149 of the Local Democracy, Economic Development and Construction Act 2009[^f00001], makes the following Order:
Citation and interpretation

- (1) This Order may be cited as the Local Democracy, Economic Development and Construction Act 2009 (Commencement No. 2) (England) Order 2011.
- (2) In this Order, “the Act” means the Local Democracy, Economic Development and Construction Act 2009.
Extent, application and day of provisions coming into force

So far as extending to England and Wales, but not in relation to construction contracts which relate to the carrying out of construction operations in Wales, section 138 (to the extent not already in force) and sections 139 to 145 of the Act come into force on 1st October 2011.

Explanatory note
(This note is not part of the Order)
EXPLANATORY NOTE
So far as extending to England and Wales, this Order commences provisions of Part 8 of the Local Democracy, Economic Development and Construction Act 2009 (“the 2009 Act”). Part 8 relates to construction contracts. It does not commence such provisions in respect of contracts relating to construction operations in Wales, however. It commences, on 1st October 2011, section 138 (to the extent not already in force) and sections 139 to 145 of the Act.
