The Apprenticeships, Skills, Children and Learning Act 2009 (Commencement No. 5) Order 2011

The Secretary of State for Business, Innovation and Skills, makes the following Order in exercise of the powers conferred by section 269(4) and (8) of the Apprenticeships, Skills, Children and Learning Act 2009[^f00001].
Citation and interpretation

- (1) This Order may be cited as the Apprenticeships, Skills, Children and Learning Act 2009 (Commencement No. 5) Order 2011.
- (2) In this Order “the Act” means the Apprenticeships, Skills, Children and Learning Act 2009.
Provisions coming into force on 1st March 2011

The following provisions of the Act come into force on 1st March 2011:
- Section 12 for England only;
- Sections 13 to 16;
- Section 38.
Provisions coming into force on 6th April 2011

The following provisions of the Act come into force on 6th April 2011:
- Section 1;
- Sections 3 to 6;
- Sections 11 for England only;
- Section 17;
- Sections 32 to 36 for England only;
- Section 37;
- Section 39 for England only;
- Section 105.
Provisions coming into force on 1st August 2011

Sections 32 to 36 come into force in relation to Wales on 1st August 2011.

Explanatory note
(This note is not part of the Order)
EXPLANATORY NOTE
This Order brings into force provisions of the Apprenticeships, Skills, Children and Learning Act (2009) (“the Act”) on 1st March, 6th April and 1st August 2011. The provisions are listed in Articles 2 to 4.
Articles 2 and 3 commence provisions that provide for the statutory apprenticeship programme for England, either on 1st March or 6th April 2011. The apprenticeship programme involves changes to employment policy, and the majority of the provisions are being commenced on 6 April 2011. Some sections are being commenced on 1st March to allow for the infrastructure for the apprenticeship programme to be put in place before 6th April.
Article 4 commences provisions for Wales on 1st August 2011 in relation to the non-devolved area of employment.
