The Rail Vehicle Accessibility (Middleton Railway Drewry Car) and (Cairngorm Funicular Railway) Exemption (Amendment) Order 2011

In accordance with section 184(1), (2), and (3) of that Act and regulation 5(2) of the Rail Vehicle Accessibility Exemption Orders (Parliamentary Procedures) Regulations 2008[^f00003], having consulted with the Disabled Persons Transport Advisory Committee and having regard to representations of the Committee, the Secretary of State has decided that this Order should be subject to annulment in pursuance of a resolution of either House of Parliament.

Citation and commencement

This Order may be cited as the Rail Vehicle Accessibility (Middleton Railway Drewry Car) and (Cairngorm Funicular Railway) Exemption (Amendment) Order 2011 and comes into force on 19th December 2011.

• (1) The Rail Vehicle Accessibility (Middleton Railway Drewry Car) Exemption Order 2002[^f00004] is amended as follows.

• (2) In article 6(b) for the words “the Middleton Railway in Leeds” substitute “a network listed in the Schedule to the Rail Vehicle Accessibility (Networks) Exemption Order 2010[^f00005].”

Article 6 of the Rail Vehicle Accessibility (Cairngorm Funicular Railway) Exemption Order 2002[^f00006] is omitted.

Explanatory note

EXPLANATORY NOTE

This Order amends the Rail Vehicle Accessibility (Middleton Railway Drewry Car) Exemption Order 2002 and the Rail Vehicle Accessibility (Cairngorm Funicular Railway) Exemption Order 2002.

Article 2 amends the condition on the exemption granted by article 4(1) of the Rail Vehicle Accessibility (Middleton Railway Drewry Car) Exemption Order 2002 to allow for the operation of the exempted vehicle on any network listed in the Schedule to the Rail Vehicle Accessibility (Networks) Exemption Order 2010.

Article 3 amends article 6 of the Rail Vehicle Accessibility (Cairngorm Funicular Railway) Exemption Order 2002 by removing the expiry date for the exemptions granted by article 4(2).
