In accordance with section 184(1), (2), and (3) of that Act and regulation 5(2) of the Rail Vehicle Accessibility Exemption Orders (Parliamentary Procedures) Regulations 2008[^f00003], having consulted with the Disabled Persons Transport Advisory Committee and having regard to representations of the Committee, the Secretary of State has decided that this Order should be subject to annulment in pursuance of a resolution of either House of Parliament.

Citation and commencement

This Order may be cited as the Rail Vehicle Accessibility (Middleton Railway Drewry Car) and (Cairngorm Funicular Railway) Exemption (Amendment) Order 2011 and comes into force on 19th December 2011.

Explanatory note

EXPLANATORY NOTE

This Order amends the Rail Vehicle Accessibility (Middleton Railway Drewry Car) Exemption Order 2002 and the Rail Vehicle Accessibility (Cairngorm Funicular Railway) Exemption Order 2002.

Article 2 amends the condition on the exemption granted by article 4(1) of the Rail Vehicle Accessibility (Middleton Railway Drewry Car) Exemption Order 2002 to allow for the operation of the exempted vehicle on any network listed in the Schedule to the Rail Vehicle Accessibility (Networks) Exemption Order 2010.

Article 3 amends article 6 of the Rail Vehicle Accessibility (Cairngorm Funicular Railway) Exemption Order 2002 by removing the expiry date for the exemptions granted by article 4(2).

An impact assessment of the effect that this instrument will have on the costs of business and the voluntary sector is available from the Rolling Stock Policy Division at the Department for Transport, Great Minster House, 33 Horseferry Road, London, SW1P 4DR, and is annexed to the Explanatory Memorandum, which is available alongside the instrument on www.legislation.gov.uk.
