In accordance with section 310(6) of that Act the Secretary of State has consulted OFCOM.

Citation and commencement

This Order may be cited as the Code of Practice for Electronic Programme Guides (Addition of Programme Services) Order 2011 and comes into force on 31st January 2012.

Addition of local television

In section 310 of the Communications Act 2003 (code of practice for electronic programme guides)—

(g) a local digital television programme service; (h) a simulcast local service.

(9) In this section “local digital television programme service” means any service which falls within a description of service in relation to which provision is for the time being made under section 244 (local digital television services). (10) In this section “simulcast local service” means a service provided in digital form and corresponding to a local digital television programme service. (11) For the purposes of subsection (10), a service corresponds to a local digital television programme service (“the relevant service”) if all of the programmes included in the relevant service are provided at the same time on both services.

Explanatory note

EXPLANATORY NOTE

This Order amends section 310 of the Communications Act 2003 by adding two types of programme service to the services specified in subsection (4) as public services channels.

Article 2 (a) inserts a “local digital television programme service” and a “simulcast local service” into section 310(4) whilst article (2)(b) adds the relevant definitions at subsections (9) to (11).
