The Alder Hey Children’s NHS Foundation Trust (Transfer of Trust Property) Order 2011

Made: 7th March 2011

Coming into force: 1st April 2011

The Secretary of State for Health makes the following Order in exercise of the powers conferred by sections 51(3), 64(5) and (6) of the National Health Service Act 2006[^f00001].

Citation, commencement and interpretation

• (1) This Order may be cited as the Alder Hey Children’s NHS Foundation Trust (Transfer of Trust Property) Order 2011 and shall come into force on 1st April 2011.

• (2) In this Order—

• “the FT” means the Alder Hey Children’s NHS Foundation Trust[^f00002];

• “the new trustees” means the trustees for the Alder Hey Children’s NHS Foundation Trust[^f00003]; and

• “the trust property” means the property specified in the schedule of trust property prepared and agreed by the FT and the new trustees and signed on behalf of the FT and the new trustees on 1st March 2011.

Transfer of trust property

• (1) On the date that this Order comes into force the trust property, and any rights and liabilities arising from that property, shall be transferred from the FT to the new trustees.

• (2) In any instrument relating to the trust property, any reference to the name by which the trustees of the trust property are to be known shall be construed as a reference to the new trustees and any reference to the FT in the name by which the charitable trust governing the trust property is to be known shall be construed as a reference to the new trustees.

EXPLANATORY NOTE

This Order transfers trust property held by the Alder Hey Children’s NHS Foundation Trust to the trustees appointed for that Trust under section 51(1) of the National Health Service Act 2006 and makes related provision. A copy of the schedule of trust property transferred under this Order can be obtained from the Department of Health, Quarry House, Quarry Hill, Leeds LS2 7UE.
