The Education and Skills Act 2008 (Commencement No. 8) Order 2012

The Secretary of State for Education makes the following Order in exercise of the powers conferred by sections 173(4) and (8) of the Education and Skills Act 2008[^f00001]:

This Order may be cited as the Education and Skills Act 2008 (Commencement No.8) Order 2012.

Provisions coming into force on 3rd September 2012

The following provisions of the Education and Skills Act 2008 come into force on 1st September 2012—

• (a) section 155 (application of s. 444 of the Education Act 1996 to alternative provision);

• (b) paragraph 43 of Schedule 1;

• (c) paragraphs 50, 51, 52 and so far as relating to those paragraphs, paragraph 48 of Schedule 1; and

• (d) paragraph 80 of Schedule 1.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order brings into force on 3rd September 2012 certain provisions of the Education and Skills Act 2008 (“the 2008 Act”) as listed in Article 2.

Article 2 brings into force section 155 of the 2008 Act which amends section 444ZA of the Education Act 1996[^f00002](“the 1996 Act”) to make clearer how the criminal offence under section 444 of the 1996 Act (failure to secure regular attendance at school of registered pupil) applies to children who are receiving alternative educational provision. It also commences certain consequential amendments to take account of the extension of the offence.
