The Localism Act 2011 (Commencement No. 1) (England) Order 2012

Made: 20th September 2012

The Secretary of State, in exercise of the power conferred by section 240(2) of the Localism Act 2011[^f00001], makes the following Order:

Citation

This Order may be cited as the Localism Act 2011 (Commencement No. 1) (England) Order 2012.

Commencement of provisions regarding assets of community value

• (1) With the exception of the provisions mentioned in paragraph (2), Chapter 3 of Part 5 of the Localism Act 2011 shall come into force for England only on the day after this Order is made in so far as it is not already in force.

• (2) The exceptions[^f00002] referred to in paragraph (1) are—

• (a) in section 88(6), paragraph (b) of the definition of “legislation”,

• (b) section 89(2)(b)(ii),

• (c) section 101(4)(b),

• (d) section 106(3),

• (e) section 106(4), and

• (f) in section 108(1), paragraph (b) of the definition of “appropriate authority”.

EXPLANATORY NOTE

This Order brings fully into force in England, on the day after it is made, Chapter 3 of Part 5 of the Localism Act 2011 (sections 87 to 108) concerning assets of community value.
