The Secretary of State, being a Minister designated for the purposes of section 2(2) of the European Communities Act 1972 , in relation to matters relating to consumer protection , makes the following Regulations in exercise of the powers conferred by section 2(2) of that Act.

A trader must not charge consumers, in respect of the use of a given means of payment, fees that exceed the cost borne by the trader for the use of that means.

SCHEDULE — MICRO-BUSINESSES AND NEW BUSINESSES

Micro-businesses

A micro-business is a business that has fewer than 10 employees (see paragraphs 7 to 9).

Existing micro-businesses

An existing micro-business is a business that was a micro-business immediately before 6th April 2013.

New businesses

unless Business 1 was itself a new business.

unless the activities, when carried on by that other person, were activities of a new business.

Grace periods in which business grows

For the purposes of this Schedule, a grace period is one in which a business grows if A is greater than B, where—

For the purposes of this Schedule, the number of employees of a business is calculated as follows—

For the purposes of this Schedule, the employees of a business are the persons who are employed for the purposes of the business.

For the purposes of this Schedule, a business that is carried on pursuant to a franchise agreement is treated as part of the business of the franchisor (and not as a separate business carried on by the franchisee).
