The Barts Health National Health Service Trust (Transfer of Trust Property) Order 2013

Coming into force: 17th June 2013

The Secretary of State for Health makes the following Order in exercise of the powers conferred by section 272(7) and (8) of, and paragraph 10(3) of Schedule 4 to, the National Health Service Act 2006[^f00001].

Citation, commencement and interpretation

• (1) This Order may be cited as the Barts Health National Health Service Trust (Transfer of Trust Property) Order 2013 and comes into force on 17th June 2013.

• (2) In this Order—

• “the new trustee” means the trustee for the Barts Health National Health Service Trust, namely the Barts and the London Charity trustee, a company limited by guarantee under company number 7168381[^f00002];

• “the NHS trust” means the Barts Health National Health Service Trust[^f00003];

• “the trust property” means the property specified in the schedule of trust property prepared by, and signed on behalf of, the NHS trust on 21st May 2013 and the new trustee on 21st May 2013.

Transfer of trust property

• (1) The trust property, and any rights and liabilities arising from that property, are transferred from the NHS trust to the new trustee.

• (2) In any instrument relating to the trust property, any reference to the trustees of the trust property will be construed as a reference to the new trustee and any reference to the NHS trust as the trustee for the trust property will be construed as a reference to the new trustee.

EXPLANATORY NOTE

This Order transfers trust property held by the Barts Health National Health Service Trust to the trustee appointed for that Trust pursuant to the National Health Service Trusts (Trust Funds: Appointment of Trustees) Order 2000 (as amended) made under paragraph 10 of Schedule 4 to the National Health Service Act 2006 and makes related provision. A copy of the schedule of trust property transferred under this Order can be obtained from the Department of Health, Quarry House, Quarry Hill, Leeds, LS2 7UE.
