The National Curriculum (Exceptions for First, Second, Third and Fourth Key Stages) (England) Regulations 2013

The Secretary of State now makes the following Regulations.

Citation and commencement

These Regulations may be cited as the National Curriculum (Exceptions for First, Second, Third and Fourth Key Stages) (England) Regulations 2013 and come into force on 1st September 2013.

Disapplication of the National Curriculum

• (1) Subject to the provisions of paragraph (2), the attainment targets, programmes of study and assessment arrangements[^f00002] specified in relation to each of the core and foundation subjects [^f00003]for the first, second, third and fourth key stages[^f00004] do not apply in relation to any pupil during the school year 2013 to 2014[^f00005].

• (2) The attainment targets, programmes of study and assessment arrangements specified in relation to the core subjects continue to apply in relation to any pupil in —

• (a) the first key stage; and

• (b) the third and fourth year of the second key stage, that is, the period beginning at the same time as the school year in which the majority of pupils in his class attain the age of ten.

• (3) The programmes of study specified in relation to the core subjects for the fourth key stage do not apply in relation to any pupil during the school year 2014 to 2015.

Revocation

The National Curriculum (Exceptions for First, Second, Third and Fourth Key Stages) (England) Regulations 2012[^f00006] are revoked.

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations make provision for the National Curriculum for England to be disapplied, with exceptions, for all key stages for the school year 2013 to 2014.

The exceptions to the disapplication are for the core subjects (mathematics, English and science) for the first key stage and for the third and fourth years of the second key stage.

They also provide for the programmes of study for the core subjects to be disapplied for the fourth key stage for the school year 2014 to 2015.

An impact assessment has not been produced for this instrument as it has no impact on businesses or civil society organisations. The instrument has a minimal impact on the public sector.
