The Secretary of State, in exercise of the powers conferred by sections 7 and 41(4) of the Employment Tribunals Act 1996[^f00001], makes the following Regulations:

Citation and commencement

These Regulations may be cited as the Employment Tribunals (Constitution and Rules of Procedure) (Consequential Amendments) Regulations 2013 and come into force on 30th August 2013.

Amendment to the Biocidal Products and Chemicals (Appointment of Authorities and Enforcement) Regulations 2013

In regulation 27(2) of the Biocidal Products and Chemicals (Appointment of Authorities and Enforcement) Regulations 2013[^f00002] for “Schedule 4 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2004”[^f00003] insert “Schedule 1 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013”[^f00004].

Amendment to the Health and Safety (Fees) Regulations 2012

  • (1) The Health and Safety (Fees) Regulations 2012[^f00005] are amended as follows.
  • (2) In regulations 17(2)(c) and 24(6)(c) for “regulation 16(1) and (3)(b) of, and Schedules 1 and 4 to, the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2004” insert “Schedule 1 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013”.

Amendments to the Pyrotechnic Articles (Safety) Regulations 2010

  • (1) Schedule 4 to the Pyrotechnic Articles (Safety) Regulations 2010[^f00006] is amended as follows.
  • (2) In paragraph 5(6)(b) for “Rules 34 to 36” insert “rules 70 to 73”.
  • (3) In paragraph 5(7) for “Employment Tribunals (Constitution and Rules of Procedure) Regulations 2004, as modified by the provisions of Schedule 4 to those Regulations” insert “Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013”.

Amendment to the Discipline of Judges (Designation) Order 2009

In regulation 3(2) of the Discipline of Judges (Designation) Order 2009[^f00007] for “regulation 8(3)(b) or (c) of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2004” insert “regulation 8(2)(b) or (c) of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013”.

Amendment to the Judicial Appointments Order 2008

In Part 1 of Schedule 1 to the Judicial Appointments Order[^f00008] 2008 for “regulation 8(3)(a) of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2004” insert “regulation 8(2)(a) of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013”.

Amendments to the REACH Enforcement Regulations 2008

  • (1) Part 2 of Schedule 8 to the REACH Enforcement Regulations 2008[^f00009] is amended as follows.
  • (2) In paragraph 2 for “Schedule 4 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2004” insert “Schedule 1 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013”.
  • (3) In paragraph 3 for “Schedule 4” insert “Schedule 1”.

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations make amendments to a number of statutory instruments consequential on the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013. The Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 revoked and replaced the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2004.

[^f00001]: 1996 c. 17; by virtue of section 1 of the Employment Rights (Dispute Resolution) Act 1998 (c. 8) industrial tribunals were renamed employment tribunals and references to “industrial tribunal” and “industrial tribunals” in any enactment were substituted with “employment tribunal” and “employment tribunals”. There are other amending instruments but none is relevant.
