The Bus Lane Contraventions (Approved Local Authorities) (England) (Amendment) and Civil Enforcement of Parking Contraventions Designation Order 2013

Accordingly, the Secretary of State[^f00004] makes this Order.

Citation and commencement

This Order may be cited as the Bus Lane Contraventions (Approved Local Authorities) (England) (Amendment) and Civil Enforcement of Parking Contraventions Designation Order 2013 and comes into force on 30th May 2013.

Revocation of previous orders

The following orders are revoked—

• (a) The Civil Enforcement of Parking Contraventions (The County Council of Durham) (Durham District) Designation Order 2008[^f00005]; and

• (b) The Road Traffic (Permitted Parking Area and Special Parking Area) (County of Essex) (Borough of Colchester) Order 2002[^f00006].

Designation of civil enforcement areas and special enforcement areas under the Traffic Management Act 2004

• (1) The Secretary of State designates each of the areas mentioned in paragraph (2) as—

• (a) a civil enforcement area for parking contraventions; and

• (b) a special enforcement area.

• (2) The areas are—

• (a) the part of the area of The Northamptonshire County Council specified in Schedule 1;

• (b) the part of the area of The County Council of Durham specified in Schedule 2;

• (c) the part of the area of The Worcestershire County Council specified in Schedule 3;

• (d) the part of the area of The North Yorkshire County Council specified in Schedule 4; and

• (e) the part of the area of The Essex County Council specified in Schedule 5.

• (1) The Civil Enforcement of Parking Contraventions Designation Order 2011[^f00007] is amended as follows.

• (2) Omit article 3(2)(a) and Schedules 1 and 2.

• (1) The Bus Lane Contraventions (Approved Local Authorities) (England) Order 2005[^f00008] is amended as follows.

• (2) In the table in Schedule 2, in the row relating to The County Council of Durham, in column 2 for “2008/2567” substitute “2013/992”.

SCHEDULE 1 — The part of the area of The Northamptonshire County Council designated as a civil enforcement area for parking contraventions and as a special enforcement area

The whole of the area of Daventry District Council except—

• (a) the M1 London to Leeds motorway within the area, from the boundary with South Northamptonshire District Council at Ordnance Survey national grid reference point SP6552560370 to the boundary with Leicestershire County Council at Ordnance Survey national grid reference point SP5636877779, including its slip roads;

• (b) the M45 Dunchurch to Crick Motorway within the area, from its junction with the M1 at Ordnance Survey national grid reference point SP5865469979 to the boundary with Warwick District Council at Ordnance Survey national grid reference point SP5032070821, including its slip roads; and

• (c) the A14 Catthorpe to Felixstowe within the area, from the boundary with Leicestershire County Council at Ordnance Survey national grid reference point SP5714778257 to the boundary with Kettering Borough Council at Ordnance Survey national grid reference point SP7562579139, including its slip roads.

SCHEDULE 2 — The part of the area of The County Council of Durham designated as a civil enforcement area for parking contraventions and as a special enforcement area

The whole of the area of The County Council of Durham except—

• (a) the A1M for its entire length within the area including its slip roads and circulatory carriageways at junctions 59, 60, 61, 62 and 63;

• (b) the A19 between the boundary with Hartlepool Borough Council at Ordnance Survey national grid reference point NZ4437233949, and the boundary with Sunderland City Council at Ordnance Survey national grid reference point NZ3981150452, including its on and off slip roads; and

• (c) the A66 between the boundary with The North Yorkshire County Council at Ordnance Survey national grid reference point NZ1295510270 and the boundary with Cumbria County Council at Ordnance Survey national grid reference point NY8951512375, including its on and off slip roads at Ordnance Survey national grid reference point NY9959613755.

SCHEDULE 3 — The part of the area of The Worcestershire County Council designated as a civil enforcement area for parking contraventions and as a special enforcement area

The whole of the area of The Bromsgrove District Council except—

• (a) the M42 motorway from junction 4a of the M5 at Ordnance Survey national grid reference point SO395248272893 to the boundary with The Stratford-on-Avon District Council at Ordnance Survey national grid reference point SP407945273002, including its slip roads; and

• (b) the M5 motorway from the boundary with The Wychavon District Council at Ordnance Survey national grid reference point SO393237268372 to the boundary with The Dudley Metropolitan Borough Council at Ordnance Survey national grid reference point SO398906281657, including its slip roads.

SCHEDULE 4 — The part of the area of The North Yorkshire County Council designated as a civil enforcement area for parking contraventions and as a special enforcement area

The whole of the areas of The Craven District Council, The Hambleton District Council, The Richmondshire District Council, The Ryedale District Council and The Selby District Council except—

• (a) The A64 from—

• (i) the eastern boundary of the Leeds City Council at Ordnance Survey national grid reference point SE4280940115 to the western boundary of the City of York Council at Ordnance Survey national grid reference point SE5415946739, including its on and off slip roads; and

• (ii) the eastern boundary of the City of York Council at Ordnance Survey national grid reference point SE6747258768 to the boundary of Scarborough Borough Council at Ordnance Survey national grid reference point TA0195881058, including its on and off slip roads;

• (b) The A1(M)/A1 from—

• (i) the boundary of Selby District Council at Ordnance Survey national grid reference point SE4721026680 to the boundary of Selby District Council at Ordnance Survey national grid reference point SE4540231775, including its on and off slip roads;

• (ii) the boundary of Selby District Council at Ordnance Survey national grid reference point SE4316039839 to the boundary of Selby District Council at Ordnance Survey national grid reference point SE4307340418, including its on and off slip roads; and

• (iii) the northern boundary of Harrogate Borough Council at Ordnance Survey national grid reference point SE3435479072 to the boundary of Darlington Borough Council at Ordnance Survey national grid reference point NZ2460313994, including its on and off slip roads;

• (c) The A66 from its junction with the A1 at Scotch Corner at Ordnance Survey national grid reference point NZ2140505293 to the boundary of the County Council of Durham at Ordnance Survey national grid reference point NZ1295510270, including its on and off slip roads;

• (d) the A66(M) from junction 57 of the A1 at Ordnance Survey national grid reference point NZ2431411701 to the boundary of Darlington Borough Council at Ordnance Survey national grid reference point NZ2702012601, including its on and off slip roads;

• (e) the A168 from the boundary of Harrogate Borough Council at Ordnance Survey national grid reference point SE4027775554 to the transition point with the A19 at Ordnance Survey national grid reference point SE4400981565, including its on and off slip roads;

• (f) the A19 from the transition point with the A168 at Ordnance Survey national grid reference point SE4400981565 to the boundary of Stockton-on-Tees Borough Council at Ordnance Survey national grid reference point NZ4389408601, including its on and off slip roads; and

• (g) the M62 from the eastern boundary of Wakefield Council at Ordnance Survey national grid reference point SE5298522382 to the western boundary of the East Riding of Yorkshire Council at Ordnance Survey national grid reference point SE6073521279, including its on and off slip roads.

SCHEDULE 5 — The part of the area of The Essex County Council designated as a civil enforcement area for parking contraventions and as a special enforcement area

The whole of the Borough of Colchester except—

• (a) the A12 road, with the exception of Old London Road between Ordnance Survey national grid reference point TL9136523485 and Ordnance Survey national grid reference point TL9100523123, for the whole of its length within the Borough of Colchester;

• (b) the A133 road from its junction with the A12 road to its junction with the road known as Cymbeline Way;

• (c) the A1124 from its junction with the B1408 road, known as London Road, to its junction with the road known as Abbots Lane; and

• (d) the A120 road for the whole of its length within the Borough of Colchester.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order designates part of the area of each of The Northamptonshire County Council, The County Council of Durham, The Worcestershire County Council, The North Yorkshire County Council and The Essex County Council as a civil enforcement area for parking contraventions and as a special enforcement area for the purposes of Part 6 of the Traffic Management Act 2004.

It simultaneously revokes the Civil Enforcement of Parking Contraventions (The County Council of Durham) (Durham District) Designation Order 2008 (S.I. 2008/2567, “the 2008 Order”) made under the Traffic Management Act 2004 and the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Essex) (Borough of Colchester) Order 2002 (S.I. 2002/2186) made under the predecessor designation scheme contained in the Road Traffic Act 1991.

This Order amends the Civil Enforcement of Parking Contraventions Designation Order 2011 (S.I. 2011/2431, “the 2011 Order”). By amending the 2011 Order and revoking the 2008 Order, this Order designates the whole of the area of The County Council of Durham with the exception of the roads referred to at Schedule 2.

This Order also makes a consequential amendment to the Bus Lane Contraventions (Approved Local Authorities) (England) Order 2005 (S.I. 2005/2755).

An impact assessment has not been produced as no impact on the private or voluntary sectors is foreseen. An Explanatory Memorandum is available alongside the instrument on the UK legislation website, www.legislation.gov.uk .

[^f00003]: By the County Durham (Structural Change) Order 2008 (S.I. 2008/493), the County Durham council was appointed as the single tier council for the whole county with effect from 1st April 2009. All other local government areas within the county were simultaneously abolished and all other councils were wound up and dissolved. For the purposes of enactments relating to local government, the Order created a new district called County Durham whose area is coterminous with that of County Durham.
