The Secretary of State, in exercise of the powers conferred by sections 1, 2, 4, 5 and 7 of the Export Control Act 2002[^f00001], makes the following Order:
Citation and commencement

This Order may be cited as the Export Control (Amendment) (No. 2) Order 2014 and shall come into force on 17th May 2014.
Amendments to the Export Control Order 2008

- (1) The Export Control Order 2008[^f00002] is amended as follows.
- (2) For Schedule 2 to the Export Control Order 2008 (Military goods, software and technology) substitute the replacement Schedule 2 set out in the Schedule to this Order.
- (3) In paragraph PL8001 (Explosive-related goods and technology) of Schedule 3 to the Export Control Order 2008 (UK controlled dual-use goods, software and technology), in the Note in sub-paragraph 3 of paragraph (a):
- (a) in point b., omit “and”; and
- (b) for point c., substitute:

Explanatory note

EXPLANATORY NOTE
This Order implements Directive 2014/18/EU amending Directive 2009/43/EC of the European Parliament and of the Council as regards the list of defence related products (O.J. L40, 11.2.14, p.20) (“the amending Directive”). Directive 2009/43/EC (O.J. L146, 10.6.09, p.1) simplifies the terms and conditions of transfers within the Union of defence related products listed in the Annex which corresponds to the list in the Common Military List of the Union (“CML”). This CML was updated in 2013 and the amending Directive makes the necessary changes to the Annex to incorporate these changes.
The Order replaces Schedule 2 to the Export Control Order 2008 which lists military goods, software and technology which are subject to export controls (“the UK list”). The content of the UK list derives partly from an international regime known as the Wassenaar Arrangement adopted in the EU through the CML, as well as from domestic UK controls. The substituted text of the Schedule reflects the changes.
The Order also makes an unrelated technical amendment to a UK controlled item in Schedule 3 to the Export Control Order 2008 to exclude from control firing sets for fireworks.
An Impact Assessment has not been prepared in respect of this Order as minimal or no impact on the private or voluntary sectors is foreseen. An Explanatory Memorandum and a transposition note are available alongside the instrument on the www.legislation.gov.uk website. Copies have also been placed in the Libraries of both Houses of Parliament.
