The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by sections 49(3) and (4) of the Children and Families Act 2014 .

In accordance with section 135(6)(a) of that Act, a draft of this instrument was laid before Parliament and approved by resolution of each House of Parliament.

Citation and commencement

These Regulations may be cited as the Special Educational Needs (Personal Budgets) Regulations 2014 and come into force on 1st September 2014.

Interpretation

In these Regulations—

Information, advice and support

Where a local authority maintains an EHC plan or is securing the preparation of an EHC plan for a child or young person, it must make arrangements for the provision to the child's parent or young person of the following information—

Request for a personal budget including direct payments

Persons to whom direct payments may be made

Decision to make direct payments

Decisions not to make direct payments

Where a local authority decides not to make direct payments it must—

Conditions for direct payments

Permission of school etc

The amount of direct payments

10

Monitoring and review of direct payments

Reducing the amount of direct payments

Repayment and recovery of direct payments

13

Stopping making direct payments

14

Transition: when a child becomes a young person

Capacity
