The Donations to Candidates (Anonymous Registration) Regulations 2014

Made: 9th July 2014

Coming into force: 15th September 2014

Accordingly, the Secretary of State makes the following Regulations in exercise of the powers conferred by paragraph 10(2) of Schedule 2A to the Representation of the People Act 1983[^f00003].

Citation and commencement

• (1) These Regulations may be cited as the Donations to Candidates (Anonymous Registration) Regulations 2014.

• (2) These Regulations come into force on 15th September 2014.

Certificate of anonymous registration prescribed for purposes of donations and loans

• (1) A certificate of anonymous registration issued under any of the provisions in paragraph (2) is evidence that an individual has an anonymous entry in an electoral register for the purposes of paragraph 10(2) of Schedule 2A to the Representation of the People Act 1983.

• (2) The provisions are—

• (a) regulation 45G of the Representation of the People (England and Wales) Regulations 2001[^f00004];

• (b) regulation 45F of the Representation of the People (Scotland) Regulations 2001[^f00005];

• (c) regulation 53D of the Representation of the People (Northern Ireland) Regulations 2008[^f00006].

Revocations

The following provisions are revoked—

• (a) regulation 45H of the Representation of the People (England and Wales) Regulations 2001[^f00007];

• (b) regulation 45G of the Representation of the People (Scotland) Regulations 2001[^f00008].

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

The registration officer in England and Wales, Scotland and Northern Ireland is required to issue a certificate of anonymous entry to persons with an anonymous entry in the electoral register maintained by that officer.

Regulation 2 provides that any such certificate of anonymous entry can be used by a candidate as evidence that a donor is registered in an electoral register for the purpose of reporting donations to the Electoral Commission.
