The Water Act 2014 (Commencement No. 1) Order 2014

Made: 8th July 2014

The Secretary of State and the Welsh Ministers make the following Order in exercise of the powers conferred by section 94(3) and (6) of, and Schedule 12 to, the Water Act 2014[^f00001].

Citation and interpretation

• (1) This Order may be cited as the Water Act 2014 (Commencement No. 1) Order 2014.

• (2) In this Order “the Act” means the Water Act 2014.

Provisions coming into force on 14th July 2014

The following provisions of the Act come into force on 14th July 2014—

• (a) section 40(1) (charging of fees by assessors for the enforcement of water quality);

• (b) Schedule 9 (publication requirements under the Land Drainage Act 1991[^f00002]).

Provision coming into force on 1st October 2014

Section 59 of the Act (main rivers in England and Wales) comes into force on 1st October 2014.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order is the first commencement order made under the Water Act 2014 (c.21) (“the Act”).

Article 2 of the Order brings into force on 14th July 2014 section 40(1) of the Act which inserts a new section 86ZA into the Water Industry Act [1991 (c.56)](https://www.legislation.gov.uk/ukpga/1991/56). This section enables the Secretary of State to make an order conferring power on the Chief Inspector of Drinking Water to charge fees in relation to regulatory activities undertaken by the Drinking Water Inspectorate and enables the Welsh Ministers to make an equivalent order relating to the Chief Inspector of Drinking Water for Wales. Article 2 also brings into force on the same date Schedule 9 to the Act which amends the Land Drainage Act [1991 (c.59)](https://www.legislation.gov.uk/ukpga/1991/59) to remove certain restrictions on the way in which public notices relating to internal drainage boards in England are published.

Article 3 brings into force on 1st October 2014 section 59 of the Act which inserts new provisions about the main river maps for England and Wales into the Water Resources Act [1991 (c.57)](https://www.legislation.gov.uk/ukpga/1991/57).

An impact assessment of the effect that the Act will have on the costs of business and the voluntary sector has been produced, and copies are available from the website of the Department for Environment, Food and Rural Affairs at www.gov.uk/defra or from the Department for Environment, Food and Rural Affairs, Nobel House, 17 Smith Square, London SW1P 3JR. No separate impact assessment has been produced for this instrument.

[^f00001]: 2014 c.21. The power in section 94(3) of the Act to appoint a day on which the remaining provisions of the Act shall come into force is vested in the “appropriate authority”. Section 94(6) of the Act states that the appropriate authority is the Secretary of State except as otherwise stated in the table in Schedule 12 to the Act. The appropriate authority in relation to section 40(1) of the Act is the Secretary of State, in relation to the power of the Secretary of State to make an order under section 86ZA of the Water Industry Act 1991 (c.56) (as inserted by section 40(1)), and is the Welsh Ministers, in relation to the power of the Welsh Ministers to make an order under section 86ZA of the Water Industry Act 1991 (as inserted by section 40(1)). The appropriate authority in relation to Schedule 9 to the Act is the Secretary of State. The appropriate authority in relation to section 59 of the Act is the Secretary of State, in relation to the main river map for England, and is the Welsh Ministers, in relation to the main river map for Wales.
