The Borders, Citizenship and Immigration Act 2009 (Commencement No. 3) Order 2014

Made: 28th September 2014

The Secretary of State, in exercise of the powers conferred by section 58(2) and (3)(b) of the Borders, Citizenship and Immigration Act 2009[^f00001] and having consulted the Scottish Ministers in accordance with section 58(15) of that Act, makes the following Order:

Citation

This Order may be cited as the Borders, Citizenship and Immigration Act 2009 (Commencement No. 3) Order 2014.

Appointed date

The date appointed for the coming into force of the following provisions of the Borders, Citizenship and Immigration Act 2009 is 27th October 2014—

• (a) section 41(5), insofar as it inserts subsection (8)(b) into section 41 of the British Nationality Act 1981[^f00002], excepting the words “(bc), (bd) or (be)”; and

• (b) section 52 (extension of sections 1 to 4 of the UK Borders Act 2007[^f00003] to Scotland).

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order brings into force on 27th October 2014 section 41(5) of the Act to the extent that it specifies the procedure for regulations made under section 41(1)(bza) of the British Nationality Act 1981.

This Order also brings into force section 52 of the Borders, Citizenship and Immigration Act 2009 (“the Act”) on 27th October 2014. Section 52 of the Act extends sections 1 to 4 of the UK Borders Act 2007 (detention at ports) to Scotland.
