The Anti-social Behaviour, Crime and Policing Act 2014 (Commencement No. 7, Saving and Transitional Provisions) (Amendment) Order 2014

The Secretary of State, in exercise of the powers conferred by section 185(1) and (7) of the Anti-social Behaviour, Crime and Policing Act 2014[^f00001], makes the following Order.

Citation and commencement

This Order may be cited as the Anti-social Behaviour, Crime and Policing Act 2014 (Commencement No. 7, Saving and Transitional Provisions) (Amendment) Order 2014 and comes into force on 20th October 2014.

Amendments to the Anti-social Behaviour, Crime and Policing Act 2014 (Commencement No. 7, Saving and Transitional Provisions) Order 2014

The Anti-social Behaviour, Crime and Policing Act 2014 (Commencement No. 7, Saving and Transitional Provisions) Order 2014[^f00002] is amended in accordance with articles 3 to 5.

In article 3 (provisions coming into force on 20th October 2014)—

• (a) in sub-paragraph (g)(vi) for “32 to 45” substitute “32 to 43 and 45”;

• (b) sub-paragraph (g)(vii) is renumbered (viii);

• (c) before sub-paragraph (g)(viii) insert—

(vii) paragraph 44 insofar as it relates to the repeal of the following provisions of the Violent Crime Reduction Act 2006[^f00003]— (aa) sections 6 to 8; (bb) section 9(1)(b) and (9); (cc) sections 9(7)(b) and 10(1) insofar as they relate to a drinking banning order made under section 6 of the Violent Crime Reduction Act 2006.

In article 4 (saving provision in relation to the coming into force of Part 2) for “section 8 continues” substitute “sections 8 and 9 continue”.

After article 5, insert—

(5A) Until Part 1 of the 2014 Act comes into force, section 102(1)(c) is to be read as if for “an injunction under section 1” there were substituted “an order under section 1 of the Crime and Disorder Act 1998[^f00004] or an injunction under section 153A of the Housing Act 1996[^f00005]”.

Explanatory note

EXPLANATORY NOTE

This Order amends the Anti-social Behaviour, Crime and Policing Act 2014 (Commencement No. 7, Saving and Transitional Provisions) Order 2014 (the 2014 Order”) which brings into force various provisions of the Anti-social Behaviour, Crime and Policing Act 2014 (“the 2014 Act”). The amendments are necessary to correct errors in the 2014 Order.

Article 3 amends certain provisions in Article 3 of the 2014 Order which bring into force provisions in the 2014 Act relating to criminal behaviour orders, dispersal powers, community protection and local involvement and accountability.

Article 4 amends Article 4 of the 2014 Order which makes saving provision in relation to the coming into force of Part 2 of the 2014 Act to allow for parenting orders to be made where a criminal behaviour order has been made.

Article 5 makes transitional provision in relation to the coming into force of Part 6 of the 2014 Act.
