The Pensions Act 2008 (Commencement No.15) Order 2014

The Secretary of State for Work and Pensions, in exercise of the powers conferred by section 149(1) of the Pensions Act 2008[^f00001], makes the following Order.

Citation and interpretation

This Order may be cited as the Pensions Act 2008 (Commencement No.15) Order 2014.

Commencement of provision

The day appointed for the coming into force of section 137 of the Pensions Act 2008 is 13th March 2014.

Explanatory note

EXPLANATORY NOTE

This Order brings into force section 137 (Official pensions: adjustments of increase in survivors’ pensions) of the Pensions Act 2008 (c.30) (‘the 2008 Act’) which amends section 59 of the Social Security Pensions Act 1975 (c.60).

Section 59 of the Social Security Pensions Act 1975 deals with the index-linking of public service pensions. Section 59(5ZA) as amended by section 137 of the 2008 Act reflects the different guaranteed minimum pension entitlements of widowers and widows, and extends the operation of section 59(5ZA) so that it will apply to future payments of pensions to civil partners.

Article 2 brings section 137 into force on 13th March 2014.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
