The Traffic Management Act 2004 (Commencement No. 8) (England) Order 2015

The Secretary of State for Transport makes the following Order in exercise of powers conferred by section 99 of the Traffic Management Act 2004[^f00001].

This Order may be cited as the Traffic Management Act 2004 (Commencement No. 8) (England) Order 2015.
Commencement of provision

Section 59 (Guidance about inspections) of the Traffic Management Act 2004 comes into force as respects England on 6th April 2015.

Explanatory note

EXPLANATORY NOTE
This Order brings into force, as respects England, a provision of Part 4 (Street Works) of the Traffic Management Act 2004 (the “2004 Act”).
Article 2 brings section 59 of the 2004 Act into force on 6th April 2015. Section 59 inserts a new section 73F into the New Roads and Street Works Act 1991. This provides for the Secretary of State to issue or approve guidance to street authorities on the carrying out of inspections of street works. A street authority must have regard to the guidance when carrying out any inspections or investigatory works.
