The National Assembly for Wales (Representation of the People) (Amendment) (No. 2) Order 2016
Made: 3rd March 2016
Coming into force in accordance with article 1(2) and (3)
Accordingly, the Secretary of State, in exercise of the powers conferred by sections 13(1), (2)(d) and (4)(a) and (b) and 157(2)(c) of the Government of Wales Act 2006 (as extended by section 26(3) of the Welsh Language Act 1993[^f00003]) makes the following Order:
Citation and commencement

- (1) This Order may be cited as the National Assembly for Wales (Representation of the People) (Amendment) (No. 2) Order 2016.
- (2) It comes into force on the day after the day on which it is made.
- (3) If this Order comes into force on the same day as the day on which the National Assembly for Wales (Representation of the People) (Amendment) Order 2016 comes into force, it comes into force immediately after that Order[^f00004].
- (4) The substitution by article 2(8) of forms CN1, CN2, CN3 and CN4 applies only in respect of an election the poll for which is on or after 1st May 2016.
Amendment of Schedule 10 to the National Assembly for Wales (Representation of the People) Order 2007

- (1) Amend Schedule 10 to the National Assembly for Wales (Representation of the People) Order 2007[^f00005] (appendix of forms) as follows.
- (2) In form CC1 in Welsh (form of postal voting statement where the poll is not taken together with another)—
- (a) on the front of the form, for the words “Swyddog Canlyniadau i adael y blwch yn wag os yw’r etholwr wedi cael hepgoriad” (the first time they occur) substitute “Swyddog Canlyniadau i roi enw ond ei adael yn wag os yw wedi’i anfon at etholwr anhysbys”;
- (b) on the front of the form, for the words “Swyddog Canlyniadau i adael y blwch yn wag os yw’r etholwr wedi cael hepgoriad” (the second time they occur) substitute “Swyddog Canlyniadau i eithrio’r blwch lle mae’r etholwr wedi cael ildiad hawl”;
- (c) on the back of the form, in paragraph 3, in the words beginning “*Swyddog Canlyniadau” and ending “bo’n briodol” for “diwygio” substitute “ddiwygio”.
- (3) In form CC2 in Welsh (form of postal voting statement where proceedings on the issue and receipt of postal ballot papers are taken together with those proceedings at another election)—
- (a) on the front of the form, in the words beginning “* Swyddog Canlyniadau i roi enw” and ending “etholwr anhysbys” for “gadeal” substitute “ei adael”;
- (b) on the front of the form, for the words “Swyddog Canlyniadau i adael y blwch yn wag os yw’r etholwr wedi cael hepgoriad” substitute “Swyddog Canlyniadau i eithrio’r blwch lle mae’r etholwr wedi cael ildiad hawl”;
- (c) on the back of the form, in the instruction “*Swyddog Canlyniadau i ychwanegu/diwygio fel y bo’n briodol” for “diwygio” substitute “i ddiwygio”.
- (4) In form CC3 in Welsh (form of postal voting statement where proceedings on the issue and receipt of postal ballot papers are not taken together with those proceedings at another election), on the front of the form—
- (a) in the heading, for “Ffurflen pleidleisio drwy’r post” substitute “Ffurflen datganiad pleidleisio drwy’r post”;
- (b) in the words beginning “* Swyddog Canlyniadau i roi enw” and ending “etholwr anhysbys” for “gadeal” substitute “ei adael”;
- (c) for the words “Swyddog Canlyniadau i adael y blwch yn wag os yw’r etholwr wedi cael hepgoriad” substitute “Swyddog Canlyniadau i eithrio’r blwch lle mae’r etholwr wedi cael ildiad hawl”.
- (5) In form CK (constituency ballot paper), in the words beginning “Pleidleisiwch ar gyfer”—
- (a) after “roi” omit “[x]”;
- (b) after “croes” insert “[x]”;
- (c) after “blwch” insert “wrth”.
- (6) In form CK1 (directions as to printing the ballot paper: constituency election), in paragraph 3(c), in the words beginning “Pleidleisiwch ar” for “nesaf at” substitute “wrth ochr”.
- (7) In form CL1 (directions as to printing the ballot paper: regional election), in paragraph 3(c), in the words beginning “Pleidleisiwch unwaith” for “nesaf at” substitute “wrth ochr”.
- (8) For forms CN1, CN2, CN3 and CN4 (elector’s form of poll card, proxy’s form of poll card, postal voter’s form of poll card and postal proxy’s form of poll card) substitute forms CN1, CN2, CN3 and CN4 set out in the Schedule to this Order.

EXPLANATORY NOTE
The National Assembly for Wales (Representation of the People) Order 2007 (S.I. 2007/236) prescribes various forms in English and in Welsh for use at elections to the Welsh Assembly. Several of those forms are to be substituted by the National Assembly for Wales (Representation of the People) (Amendment) Order 2016 (S.I. 2016/272). This Order corrects some errors that appeared in the Welsh versions of the forms substituted by that Order.
An impact assessment has not been prepared for this instrument as no impact on the private or voluntary sector is foreseen.
