The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by sections 29(3) and 569(4) of the Education Act 1996[^f00001].

Citation, commencement and application

In these Regulations—

Information to be provided to the Secretary of State by local authorities

Reports to be provided to the Secretary of State by local authorities

of pupils living in the area of the local authority.

Determination of capacity of a school

For the purposes of Schedule 1, the capacity of each of the following are to be determined in accordance with the method of assessment provided in the guidance “Assessing the capacity of schools - guidance for local authorities and schools”, published by the Secretary of State on 3rd November 2023—

The Regulations set out in Schedule 3 are revoked.

SCHEDULE 1 — School capacity etc. information

The capacity, on 1st May of the collection year, of—

In relation to each mainstream school located in the area of the local authority, for each of the three school years starting with the school year beginning in the collection year, any planned increase or decrease in the capacity of each year group in the school.

which is experiencing or is expected to experience a shortfall or excess of mainstream school places.

Where the local authority does not use planning areas, information about any geographical areas within the area of the local authority where the rate of growth or decline in the number of pupils is expected to be significantly different from the rate of growth or decline in the area of the local authority as a whole.

Any changes made to a pupil planning area within the area of the local authority since the previous collection year.

When a local authority provides information in relation to pupil planning areas in accordance with this Schedule, it must inform the Secretary the State of any changes made to any pupil planning area within the local authority’s area from the previous year.

In this Schedule—

SCHEDULE 2 — INFORMATION TO BE CONTAINED IN REPORTS PROVIDED BY LOCAL AUTHORITIES TO THE SECRETARY OF STATE

The local authority number for the local authority.

The name of the local authority.

The date of the report.

The sum of the admission numbers (which has the meaning given in section 88D(1) of the School Standards and Framework Act 1988 [^f00005]) of all primary schools and secondary schools in the area of the local authority.

For each child living in the area of the local authority in respect of whom an application or an offer is made, the following information—

In respect of any application made by a home applicant, whether such an application was received via the local authority’s website.

In respect of every preference for a school expressed in the application of a home applicant, the following information—

In respect of any offer made in respect of a child living in the area of the local authority, the following information—
