The Secretary of State, in exercise of the powers conferred by sections 59 and 60 of the Town and Country Planning Act 1990[^f00001], makes the following Order:

Citation and Commencement

This Order may be cited as the Town and Country Planning (Operation Stack) Special Development (Amendment) Order 2016 and comes into force on 31st May 2016.

Amendment of Order

The Town and Country Planning (Operation Stack) Special Development Order 2015[^f00002] is amended as follows.

In article 3 (temporary planning permission), in paragraph (2) for “on 1st June 2016” substitute “at the end of 31st December 2017”.

In article 4 (conditions and limitations), in paragraph (3) for “1st June 2016” substitute “31st December 2017”.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order amends the Town and Country Planning (Operation Stack) Special Development Order 2015 (S.I. 2015/1635) (“the 2015 Order”) to provide that the planning permission granted by the 2015 Order ceases at the end of 31st December 2017.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen. An Explanatory Memorandum is published alongside this Order at www.legislation.gov.uk.
