The Energy Act 2016 (Commencement No. 1 and Savings Provisions) (Amendment) Regulations 2016

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 84(3) of the Energy Act 2016[^f00001].

These Regulations may be cited as the Energy Act 2016 (Commencement No. 1 and Savings Provisions) (Amendment) Regulations 2016.

Amendment to the Energy Act 2016 (Commencement No. 1 and Savings Provisions) Regulations 2016

For regulation 3 of the Energy Act 2016 (Commencement No. 1 and Savings Provisions) Regulations 2016[^f00002], substitute—

(3) The following provisions of the Energy Act 2016 come into force on 12th July 2016— (a) subsections (1) to (3) of section 1 (the OGA), (b) section 3 (transfer of property, rights and liabilities to the OGA), (c) section 4 (transfer of staff to the OGA), (d) section 5 (transfer schemes: supplementary), (e) section 13 (levy on licence holders), (f) section 14 (the licensing levy: regulations), and (g) section 78 (onshore wind generating stations in England and Wales).

Explanatory note

EXPLANATORY NOTE

These Regulations amend the Energy Act 2016 (Commencement No. 1 and Savings Provisions) Regulations 2016 (S.I. 2016/602 (C. 43)) (the “Commencement Regulations”) by substituting regulation 3. As substituted, regulation 3 omits paragraph (h) of the Commencement Regulations, which provided for the commencement of section 83 of the Energy Act 2016 (c. 20) (the “2016 Act”) on 12th July 2016. Section 83 of the 2016 Act disapplies the obligation of the Secretary of State to consult the Oil and Gas Authority before exercising a power to make regulations in respect of the first exercise of each power within one year of section 1 of the 2016 Act coming into force. However, section 83 was already brought into force by section 84(1) of that Act with effect from 12th May 2016. The new regulation 3 therefore omits regulation 3(h) of the Commencement Regulations for clarity.

An impact assessment of the effect that the 2016 Act will have on the costs of business and the voluntary sector has been produced, and a copy is available at www.legislation.gov.uk. No separate impact assessment has been produced for this instrument.
