The Secretary of State makes the following Order in exercise of the powers conferred by section 411(2) of the Communications Act 2003[^f00001].

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order provides for section 401 of the Communications Act 2003 (c. 21) to come into force on 3rd November 2017. Section 401, which was amended by section 100 of the Digital Economy Act 2017 (c. 30), enables Ofcom to publish a statement of principles, and in accordance with that statement, it can retain receipts from certain functions under the Wireless Telegraphy Act 2006 (c. 36), rather than pay them into the Consolidated Fund.
