EXPLANATORY NOTE

These Regulations bring into force the specified provisions of the Technical and Further Education Act 2017 (c. 19) (“the 2017 Act”) on 16th August 2017. These are the first commencement regulations made under the 2017 Act. Part 4 of, and paragraph 35 of Schedule 1 to, the 2017 Act came into force on the day the 2017 Act was passed.

Regulation 2: provisions coming into force on 16th August 2017 Regulation 2 commences paragraphs 13 and 14 of Schedule 1 to the Act (and paragraph 1 in so far as it relates to those paragraphs) and section 1(5) so far as it relates to those paragraphs. Paragraph 14 amends section A2B (evaluation of quality of apprenticeship assessments) of the Apprenticeships, Skills, Children and Learning Act 2009 (c. 22) (“the 2009 Act”) so as to (i) provide that the Institute for Apprenticeships and Technical Education may carry out evaluations of the quality of apprenticeship assessments and (ii) allow the Secretary of State to make regulations so as to allow the Institute to charge fees for things done by it in connection with such evaluations. Paragraph 13 is an amendment in consequence of paragraph 14.

Regulation 3: Transitional Provision Until such time as section 1(1) of the Act, which will change the name of the Institute for Apprenticeships to the Institute for Apprenticeships and Technical Education, is commenced, this transitional provision provides that the reference to “the Institute” in section A2B(4) of the 2009 Act be read as a reference to “the IfA”.
