The Higher Education and Research Act 2017 (Commencement No. 4) Regulations 2018

Made: 9th October 2018

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 124(5) and (6) of the Higher Education and Research Act 2017[^f00001].

Citation

These Regulations may be cited as the Higher Education and Research Act 2017 (Commencement No. 4) Regulations 2018.

Commencement of provisions

The following provisions of the Higher Education and Research Act 2017 come into force on 31st October 2018—

• (a) section 109(1) (except paragraphs (e) and (g));

• (b) section 109(2) to the extent it applies to any research council which ceases to exist by virtue of paragraph (a);

• (c) section 122(2) to the extent it applies to paragraph (d);

• (d) in Schedule 12 (minor and consequential amendments relating to Part 3)—

• (i) paragraph 3 (except the entry for the Medical Research Council);

• (ii) paragraph 4 (except to the extent it applies to either or both of the Medical Research Council or the Science and Technology Facilities Council);

• (iii) paragraph 5 (except to the extent it applies to the Medical Research Council and the Science and Technology Facilities Council);

• (iv) paragraph 11 (except the entries for the Chair or Chief Executive of the Science and Technology Facilities Council and the Chairman, Deputy Chairman or Chief Executive of the Medical Research Council);

• (v) paragraph 12 (except to the extent it applies to the Medical Research Council and the Science and Technology Facilities Council);

• (vi) paragraph 16(5) and (6);

• (vii) paragraph 17;

• (viii) paragraph 19;

• (ix) paragraph 24(4)(a).

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations are the fourth commencement Regulations made under the Higher Education and Research Act 2017 (c. 29).

The commencement of section 109(1) (except paragraphs (e) and (g)) causes each of the listed research councils except the Medical Research Council and the Science and Technology Facilities Council to cease to exist.

The commencement of section 109(2) causes the Royal Charters (and any supplemental Royal Charter) of each of the research councils listed at section 109(1) (except the Medical Research Council and the Science and Technology Facilities Council) to be revoked.

Minor and consequential provisions in Schedule 12 are also commenced.

These provisions are commenced on 31st October 2018.
