The Higher Education and Research Act 2017 (Commencement No. 3) Regulations 2018

Made: 26th February 2018

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 124(5) and (6) of the Higher Education and Research Act 2017[^f00001].

Citation

These Regulations may be cited as the Higher Education and Research Act 2017 (Commencement No. 3) Regulations 2018.

Provisions coming into force on 1st April 2018

The following provisions[^f00002] of the Higher Education and Research Act 2017 come into force on 1st April 2018—

• (a) sections 3 to 14 insofar as not already commenced;

• (b) sections 16 to 20 (but not to the extent that section 18 refers to section 15);

• (c) sections 22 to 24 insofar as not already commenced;

• (d) sections 28 to 37 insofar as not already commenced;

• (e) sections 42 to 49 insofar as not already commenced;

• (f) sections 53 to 55;

• (g) sections 58 to 61;

• (h) sections 64 to 66 insofar as not already commenced;

• (i) section 76;

• (j) sections 79 to 82;

• (k) sections 84 and 85 insofar as not already commenced;

• (l) sections 88 (insofar as it applies to England) and 89 (but as regards subsections (2)(h)(ii) and (4) insofar as they apply in relation to England);

• (m) sections 112 to 114;

• (n) section 122(1) to the extent it applies to paragraph (s);

• (o) section 122(2) to the extent it applies to paragraph (t);

• (p) Schedule 2;

• (q) Schedule 4, paragraphs 6 and 8 to 11;

• (r) Schedule 5;

• (s) Schedule 11, paragraphs 1 to 4, 6, 10, 12 to 29(1) and (4), 30 to 35;

• (t) Schedule 12, paragraphs 1, 2, 6, 7, 9, 10, 13 to 15, 16(1) to (4), 18, 20 to 23, 24 (1) to (3) and (4)(b) and (c), 25 to 29.

Provisions coming into force on 30th March 2018

The following provisions of the Higher Education and Research Act 2017 come into force on 30th March 2018—

• (a) sections 91 to 108;

• (b) section 109(3) and (4);

• (c) section 111;

• (d) Schedule 9.

Explanatory note

EXPLANATORY NOTE

These Regulations are the third commencement Regulations made under the Higher Education and Research Act 2017 (c. 29), and commence provisions of that Act relating to the Office for Students and the establishment and operation of United Kingdom Research and Innovation.

The provisions listed in regulation 2 come into force on 1st April 2018.

The provisions listed in regulation 3 come into force on 30th March 2018.
