The Hinkley Point C (Nuclear Generating Station) (Amendment) Order 2018

Coming into force: 24th March 2018

The Secretary of State, in exercise of the powers conferred by paragraph 2 of Schedule 6 of the Planning Act 2008, makes the following Order:

Citation and commencement

This Order may be cited as The Hinkley Point C (Nuclear Generating Station) (Amendment) Order 2018 and shall come into force on 24th March 2018.

Amendment of The Hinkley Point C (Nuclear Generating Station) Order 2013

The Hinkley Point C (Nuclear Generating Station) Order 2013 (“the Order”) is amended as follows.

Amendment to Part 1 (Authorised development) of Schedule 1 (Authorised project)

• (1) In Part 1 of Schedule 1 to the Order the description of Work No. 1A is amended as follows:

• (2) In paragraph (d)(i)—

• (a) after “Effluent Tanks” insert “and Refuelling Water Storage Tank”;

• (b) after “Battery Load Bank;” insert “and”;

• (c) after “Cooling Water Discharge Weir (Buildings)” omit “and Refuelling Water Storage Tank;”.

• (3) In paragraph (h)—

• (a) after “Service Access Buildings;” omit “and”;

• (b) in the list below “Service Access Buildings;”, insert “Underground Tunnel High Points;”; and

• (c) in the list, below “Services Ventilation Building;” insert—

• Back Up Containerised Generators; and
• Valve Room for Demineralisation Station.

Amendment to Part 2 (Temporary jetty works) of Schedule 1 (Authorised project)

• (1) Part 2 of Schedule 1 to the Order is amended as follows.

• (2) In the description of Work No. TJ1 after “elevated roadway” insert “and drainage infrastructure (including pipework and outfalls)”.

Amendment to Part 3 (Approved plans) of Schedule 1 (Authorised project)

• (1) Part 3 of Schedule 1 to the Order is amended as follows.

• (2) For the tables and headings listed under the heading “HPC Development Site”, up to the heading “HPC accommodation campus”, substitute the list in the Schedule to this Order.

Amendment to Schedule 2 (Requirements)

• (1) Schedule 2 to the Order is amended as follows.

• (2) In the table at paragraph 2—

• (a) In sub-paragraph (2) of requirement PW3, for “(Rev 02)” substitute “(Rev 03)”;

• (3) In the table at paragraph 3—

• (a) In sub-paragraph (2) of requirement P10, after “Environmental Statement” insert “and may include pipework attaching to the temporary jetty leading to an outfall at the temporary jetty head,” and after “and shall” include “(except in relation to discharge from the temporary jetty head)”;

• (4) In the table at paragraph 4—

• (a) In sub-paragraph (3) of requirement MS4, for “and 1C” substitute “, 1C and TJ1”;

• (b) After requirement MS17 insert new row—

• (c) In sub-paragraph (2) of requirement MS19, for “(Rev 02)” substitute “(Rev 03)”; and

• (d) In sub-paragraph (2) of requirement MS21, for “(Rev 02)” substitute “(Rev 03)”.

Certification of revised or substituted plans

• (1) The undertaker shall, as soon as practicable after the making of this Order, submit copies of any revised or substituted plans to the Secretary of State for certification that they are true copies of the plans referred to in this Order.

• (2) A plan so certified by the Secretary of State is admissible in any proceedings as evidence of the contents of the document of which it is a copy.

• (3) In paragraph (1), the “undertaker” has the same meaning as in article 2(1) of the Order.

SCHEDULE — Approved plans to be substituted into Part 3 (Approved plans) of Schedule 1 (Authorised project) to the Order

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order amends the Hinkley Point C (Nuclear Generating Station) Order 2013 (“the 2013 Order”), a development consent order under the Planning Act 2008 (“the Act”), which has previously been amended by the Hinkley Point C (Nuclear Generating Station) (Correction) Order 2013, the Hinkley Point C (Nuclear Generating Station) (Amendment) Order 2015 and the Hinkley Point C (Nuclear Generating Station) (Amendment) Order 2017.

This Order follows an application under paragraph 2 of Schedule 6 to the Act for a non-material change to allow an alteration to the alignment of the sea wall and the erection of additional pipework along the underside of the temporary jetty to enable discharges of water from the site. This Order also allows for the redesign and the change in size and location of a number of structures within the Hinkley Point C Permanent Development Site and amends the listed plans in Part 3 of Schedule 1 to the 2013 Order.

This Order, in article 7, provides for the certification of revised or substituted plans for use as evidence in any proceedings.

The changes to the 2013 Order take effect from the date specified in this Order.
