The Secretary of State makes these Regulations, with the consent of the Treasury, in exercise of the powers conferred by section 56(1) of the Finance Act 1973[^f00001].
Citation and commencement

These Regulations may be cited as the Plant Health etc. (Fees) (England) (Amendment) Regulations 2018 and come into force on 21st May 2018.
Amendment of the Plant Health etc. (Fees) (England) Regulations 2018

- (1) The Plant Health etc. (Fees) (England) Regulations 2018[^f00002] are amended as follows.
- (2) In regulation 8—
- (a) in paragraph (3)—
- (i) for “fee” substitute “fees”;
- (ii) for “harvested tubers is” substitute “growing crops for certification as Union grade PBTC and an inspection of harvested tubers are”;
- (b) in paragraph (6), after “which” insert “the growing crops for certification as Union grade PBTC or”.
- (3) In Schedule 5, for the entries in the table under the heading “Inspection of growing crops” substitute—

Explanatory note

EXPLANATORY NOTE
These Regulations amend the Plant Health etc. (Fees) (England) Regulations 2018 (S.I. 2018/289) to correct the fee payable in respect of the certification of pre-basic seed potatoes as Union grade PBTC under the Seed Potatoes (England) Regulations 2015 (S.I. 2015/1953) and to clarify how the fees in respect of the certification of seed potatoes under the Seed Potatoes (England) Regulations 2015 are to be calculated.
An impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
