The Coroners and Justice Act 2009 (Commencement No. 18) Order 2018

The Secretary of State makes the following Order in exercise of the powers conferred by section 182(5) of the Coroners and Justice Act 2009[^f00001]:

This Order may be cited as the Coroners and Justice Act 2009 (Commencement No. 18) Order 2018.

Commencement of provisions of the Coroners and Justice Act 2009

The following provisions of the Coroners and Justice Act 2009 come into force on 16th July 2018 —

• (a) section 177(1) so far as it relates to the provisions specified in sub-paragraph (c);

• (b) paragraphs 2(3) and 3 of Schedule 16 (extension of driving disqualification); and

• (c) paragraphs 90(1) and (2) and (6) to (9) and 91 of Schedule 21 (minor and consequential amendments).

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order commences various provisions of Schedules 16 and 21 to the Coroners and Justice Act 2009 (c. 25). The provisions in Schedule 16 provide for a person to be disqualified for the appropriate extension period from holding or obtaining a driving licence where a court in Scotland imposes a sentence of imprisonment and orders a person to be disqualified. In that case the court must add an extension period to the disqualification period to take into account the time spent in custody. The provisions in Schedule 21 make various minor and consequential amendments to the Road Traffic Offenders Act 1988 (c. 53) which set out the circumstances when the extension period generated by provisions in Schedule 16 are to be disregarded.
