The Housing and Planning Act 2016 (Commencement No. 10 and Transitional Provision) Regulations 2019

The Secretary of State, in exercise of the powers conferred by sections 212 and 216(3) of the Housing and Planning Act 2016[^f00001], makes the following Regulations:
Citation

These Regulations may be cited as the Housing and Planning Act 2016 (Commencement No. 10 and Transitional Provision) Regulations 2019.
Interpretation

In these Regulations—
- “the Act” means the Housing and Planning Act 2016;
- “compulsory purchase order” has the same meaning as in section 7(1) of the Acquisition of Land Act 1981[^f00002];
- “confirming authority” has the same meaning as in section 7(1) of the Acquisition of Land Act 1981.
Provision coming into force on 6th April 2019

In so far as it is not already commenced, section 181 (confirmation by inspector) of the Act comes into force on 6th April 2019 in relation to a compulsory purchase order for which the confirming authority is the Welsh Ministers.
Transitional provision: confirmation by inspector

The amendments made by section 181 of the Act, commenced in accordance with these Regulations, only apply to a compulsory purchase order which is submitted to the Welsh Ministers, as confirming authority, for confirmation on or after 6th April 2019.

Explanatory note
(This note is not part of the Regulations)
EXPLANATORY NOTE
These Regulations bring into force section 181 of the Housing and Planning Act 2016 (c. 22) (“the Act”) insofar as it is not already in force. Section 181 of the Act inserts new section 14D into the Acquisition of Land Act 1981 (c. 67) (“the 1981 Act”). This enables the Welsh Ministers as confirming authority to appoint an inspector to act instead of them in relation to the confirmation of a compulsory purchase order to which section 13A of the 1981 Act applies.
