Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations are made in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(d)) arising from the withdrawal of the UK from the European Union.

These Regulations make amendments to legislation in the field of teachers’ pensions. Regulation 2 amends the Teachers’ Pensions Regulations 2010 (S.I. 2010/990) and regulation 3 amends the Teachers’ Pension Scheme Regulations 2014 (S.I. 2014/512). The amendments end the recognition of employment at an accepted school, which is a member of the Council of British International Schools and is located in a member State, as accruing pension for the purposes of teachers’ pensions arrangements. Regulations 4 and 5 make savings in respect of those teachers who were employed at an accepted school and had made contributions to the relevant pension schemes.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sector is foreseen.
