Coming into force in accordance with regulation 1

In accordance with paragraph 1(3) of Schedule 7 to the European Union (Withdrawal) Act 2018, a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament.

PART 1 — Introductory

Citation and commencement

These Regulations may be cited as the European Structural and Investment Funds Common Provisions Rules etc. (Amendment etc.) (EU Exit) Regulations 2019 and come into force on exit day.

Interpretation

In these Regulations—

PART 2 — Amendment of retained direct EU legislation

Amendment of Regulation 215/2014

In this Regulation, a reference to Regulation (EU) No 1303/2013 or any provision of that Regulation is a reference to that Regulation as it applies for the purpose of support for rural development and support under Regulation 508/2014.

Amendment of Regulation 240/2014

In this Regulation, a reference to Regulation (EU) No 1303/2013 or any provision of that Regulation is to be read as a reference to that Regulation as it applies for the purpose of support for rural development and support under Regulation 508/2014.

Amendment of Regulation 480/2014

In this Regulation, a reference to Regulation (EU) No 1303/2013 or any provision of that Regulation is a reference to that Regulation as it applies for the purpose of support for rural development and support under Regulation 508/2014.

Amendment of Regulation 821/2014

PART 3 — Revocation of retained direct EU legislation

The following retained direct EU legislation is revoked to the extent that it applies to the European Agricultural Fund for Rural Development and the European Maritime and Fisheries Fund—

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations are made in exercise of the powers in section 8(1) of the European Union (Withdrawal) Act 2018 (c.16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(a), (b), (c), (d) and (g)) arising from the withdrawal of the United Kingdom from the European Union.

These Regulations make amendments to retained direct EU legislation as they relate to financial support for rural development and financial support granted under Regulation (EU) No 508/2014. Part 2 makes amendments and Part 3 makes revocations.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sector is foreseen.
