The European Parliamentary Elections (Appointed Day of Poll) Order 2019

The Minister for the Cabinet Office makes the following Order in exercise of the power conferred by section 4 of the European Parliamentary Elections Act 2002[^f00001] and now vested concurrently in the Minister.
Citation and commencement

This Order may be cited as the European Parliamentary Elections (Appointed Day of Poll) Order 2019 and comes into force on 10th April 2019.

The day appointed for the poll at the next general election of Members of the European Parliament is 23rd May 2019.

Explanatory note

EXPLANATORY NOTE
Council Decision (EU, Euratom) 2018/767 (OJ No. L 129, 25.5.2018, p. 76) sets 23rd to 26th May 2019 as the period for the ninth election of members of the European Parliament.
This Order appoints Thursday 23rd May 2019 as the day of the poll in the United Kingdom and Gibraltar.
A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.

[^f00001]: 2002 c. 24 (“the 2002 Act”); section 4 was extended to Gibraltar by section 19 of the European Parliament (Representation) Act 2003 (c. 7) (“the 2003 Act”). The power conferred on the Secretary State by section 4 was made exercisable concurrently by the Minister for the Cabinet Office and the Secretary of State by article 13 of, and paragraph 16 of Schedule 2 to, the Transfer of Functions (Elections, Referendums, Third Sector and Information) Order 2016 (S.I. 2016/997). Schedule 9 to the European Union (Withdrawal) Act 2018 (c. 16) repeals both the 2002 Act and the 2003 Act. However, the repeals of the relevant sections have not yet been commenced.
