The County Courts (Interest on Judgment Debts) (Amendment) Order 2019

The Lord Chancellor, in exercise of the powers conferred by section 74 of the County Courts Act 1984[^f00001] and with the concurrence of the Treasury, makes the following Order:
Citation and commencement

This Order may be cited as the County Courts (Interest on Judgment Debts) (Amendment) Order 2019 and shall come into force on 27th May 2019.
Amendment of the County Courts (Interest on Judgement Debts) Order 1991

- (1) Article 2 (the general rule) of the County Courts (Interest on Judgment Debts) Order 1991[^f00002] is amended as follows.
- (2) In paragraph (1), after “given” insert “, unless the court orders otherwise”.
- (3) In paragraph (2), after “from that later date” insert “, unless the court orders otherwise”.
- (4) After paragraph (2) insert—
(2A) The court may order that interest shall begin to run from a date before the date on which the relevant judgment is given.

Explanatory note

EXPLANATORY NOTE
This Order amends the County Courts (Interest on Judgment Debts) Order 1991 to enable the court to order interest on a judgment debt to run from a different date than the date when the judgment is given or the amount of the judgment is determined. The date could be from a date that is before the date of the judgment.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
