Coming into force in accordance with regulation 1

In accordance with paragraph 1(3) of Schedule 7 to the European Union (Withdrawal) Act 2018, a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament.

Part 1 — Introduction

Citation and commencement

These Regulations may be cited as the Organic Products (Production and Control) (Amendment) (EU Exit) Regulations 2020 and come into force—

Part 2 — Amendment of retained EU Legislation

Commission Regulation (EC) No 889/2008 laying down detailed rules for the implementation of Council Regulation (EC) No 834/2007 on organic production and labelling of organic products with regard to organic production, labelling and control

Part 3 — Amendment of EU Exit Legislation

(b) in point (n), omit “of a Member State”;

(c) in point (o), omit “of a Member State”;

(a) in paragraph 1, in the second subparagraph, for the words from “the Member States” to the end substitute “Great Britain”;

(ii) for “the Community” substitute “Great Britain”;

(13) In Article 25(5), for the words from “the Member State” to the end substitute “Great Britain in accordance with any relevant retained EU law”.

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations are made in exercise of the powers conferred by the European Union (Withdrawal) Act 2018 (c. 16) (in particular under sections 8(2)(a), (b), (e) and (g) and 8C of that Act) in order to address failures of retained EU law to operate effectively and other deficiencies arising from the withdrawal of the United Kingdom from the European Union, and to reflect the Protocol on Ireland/Northern Ireland in the EU withdrawal agreement.

These Regulations make amendments to subordinate legislation in the field of organic production.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sector is foreseen.
