The Public Service (Civil Servants and Others) Pensions (Amendment) Regulations 2020

Coming into force in accordance with regulation 1(2)
In accordance with section 3(5) of that Act, these Regulations are made with the consent of the Treasury.
Citation and commencement

- (1) These Regulations may be cited as the Public Service (Civil Servants and Others) Pensions (Amendment) Regulations 2020.
- (2) These Regulations come into force on 1st April 2020, save for regulation 4, which comes into force on 1st September 2020.

The Public Service (Civil Servants and Others) Pensions Regulations 2014[^f00002] are amended as follows.
Amendment of regulation 134

In regulation 134[^f00003] (rate of member contributions), in paragraph (8), after the table headed “Scheme Year 1st April 2018 to 31st March 2019 and Scheme Year 1st April 2019 to 31st March 2020” insert the following table—

Amendment of regulation 135

In regulation 135[^f00004] (amount of pensionable earnings), after paragraph (4) insert
(5) For the purpose of regulation 134, when calculating a member’s annualised rate of pensionable earnings, the amount of a payment of a member’s pensionable earnings for a pay period excludes any amounts paid to the member in that pay period in the form of arrears of, or back-dated, pensionable earnings.

Explanatory note
(This note is not part of the Regulations)
EXPLANATORY NOTE
The Public Service (Civil Servants and Others) Pensions Regulations 2014 (S.I. 2014/1964) established the new Civil Service pension scheme, also known as Alpha, and made provision for the contributions payable by members of that scheme up to 31st March 2020.
Regulation 3 of these Regulations provides for the member contribution rates for the scheme year ending on 31st March 2020 to also apply to the 1st April 2020 to 31st March 2021 scheme year, as against the revised annualised rate of pensionable earnings bands. Since these Regulations involve a change to a protected element of the scheme, the Minister for the Civil Service has consulted representatives of those likely to be affected by the change with a view to reaching agreement and has laid a report before Parliament.
Regulation 4 of these Regulations changes the treatment of payments of pensionable earnings that are either back-dated or made in arrears so that such payments are not included in the calculation that determines the member contribution rate payable by a member.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
