The Health Protection (Notification) (Amendment) (No. 2) Regulations 2020

Coming into force: 1st October 2020
In accordance with section 45Q(3) of the Public Health (Control of Disease) Act 1984, the Secretary of State declares that in his opinion these Regulations do not contain any provision made by virtue of section 45C(3)(c) of that Act which imposes or enables the imposition of a special restriction or requirement, or any other restriction or requirement which has or would have a significant effect on a person’s rights.
Citation and commencement

These Regulations may be cited as the Health Protection (Notification) (Amendment) (No. 2) Regulations 2020 and come into force on 1st October 2020.
Amendments to the Health Protection (Notification) Regulations 2010

- (1) The Health Protection (Notification) Regulations 2010[^f00002] are amended as follows.
- (2) In regulation 4 (duty to notify causative agents found in human samples), after paragraph (2)(d) insert—
(da) the results of any antimicrobial susceptibility test and any resistance mechanism identified in respect of the sample;
- (3) In Schedule 2 (causative agents), at the appropriate place insert—
Acquired carbapenemase-producing Gram-negative bacteria

Explanatory note
(This note is not part of the Regulations)
EXPLANATORY NOTE
These Regulations amend the Health Protection (Notification) Regulations 2010 (S.I. 2010/659).
Regulation 2(2) adds to the information required to be included in the notification of a causative agent to Public Health England the results of any antimicrobial susceptibility test and any resistance mechanism identified in respect of the sample. Regulation 2(3) adds Acquired carbapenemase-producing Gram-negative bacteria to the list of causative agents in Schedule 2.
A full impact assessment has not been produced for this instrument because no, or no significant, impact on the private, voluntary or public sectors is foreseen. An Explanatory Memorandum has been published alongside these Regulations on www.legislation.gov.uk.
