The Health Protection (Coronavirus, International Travel) (England) (Amendment) (No. 5) Regulations 2020

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 45B, 45F(2) and 45P(2) of the Public Health (Control of Disease) Act 1984[^f00001].

Citation and commencement

These Regulations may be cited as the Health Protection (Coronavirus, International Travel) (England) (Amendment) (No. 5) Regulations 2020 and come into force on 31st July 2020.

Amendment of the Health Protection (Coronavirus, International Travel) (England) Regulations 2020

• (1) The Health Protection (Coronavirus, International Travel) (England) Regulations 2020[^f00002] are amended as follows.

• (2) In regulation 4 (requirement to self-isolate), after paragraph (8) insert—

(8A) Paragraph (2) does not require P to remain in isolation from a person (“V”) when V is at the place where P is self-isolating— (a) to provide emergency assistance, (b) to provide care or assistance, including relevant personal care within the meaning of paragraph 1(1B) or 7(3B) of Schedule 4 to the Safeguarding Vulnerable Groups Act 2006[^f00003], to P or to any other person who is living in the place where P is self-isolating, (c) to provide medical assistance, including to provide any of the services mentioned in paragraph (9)(b), to P or to any other person who is living in the place where P is self-isolating, where this is required urgently or on the advice of a registered medical practitioner, (d) to provide veterinary services, where this is required urgently or on the advice of a veterinary surgeon, (e) to provide critical public services, including those mentioned in paragraph (9)(g)(ii)(aa) and (bb).

• (3) In Schedule 2 (persons not required to comply with regulation 3 or 4)—

• (a) in paragraph 2(1)(a), for “14 days of their arrival” substitute “the period during which they would, but for this paragraph, have had to self-isolate in accordance with regulation 4”,

• (b) in paragraph 3(1)(b)—

• (i) for “immediately preceding their arrival” substitute “ending with the day immediately preceding the day of their arrival in the United Kingdom”,

• (ii) after “visiting force” insert “, where they have not disembarked”,

• (iii) for “immediately preceding its arrival” substitute “ending with the day of its arrival”,

• (c) in paragraph 4(a), for “14 days of arrival” substitute “the period during which they would, but for this paragraph, have had to self-isolate in accordance with regulation 4”,

• (d) in paragraph 13(1)(a), for “14 days of their arrival” substitute “the period during which they would, but for this paragraph, have had to self-isolate in accordance with regulation 4”,

• (e) in paragraph 17(2)(b), for “has the meaning given in section 17BA(6) and 219(1)” substitute “means the holder of a sewerage licence under section 17BA[^f00004]”,

• (f) for paragraph 17A substitute—

(17A) (1) Workers engaged in essential or emergency works relating to flood and coastal erosion risk management on behalf of— (a) the Environment Agency, or (b) a lead local flood authority in England. (2) For the purposes of sub-paragraph (1)— (a) “flood” and “coastal erosion” have the meanings given in section 1 of the Flood and Water Management Act 2010[^f00005], (b) “lead local flood authority” has the meaning given in section 6(7) of that Act, (c) “risk management” has the meaning given in section 3 of that Act[^f00006].

• (g) in paragraph 24(1), for “14 days of their arrival” substitute “the period during which they would, but for this paragraph, have had to self-isolate in accordance with regulation 4”,

• (h) omit paragraph 30.

• (4) In Schedule 3 (specified competitions)—

• (a) omit the following entries—

• (i) “Professional Darts Corporation Summer Series”,

• (ii) “Professional Golfers’ Association Betfred British Masters Championship”,

• (iii) “Moët & Chandon July Festival horse-racing”,

• (iv) “QIPCO King George Diamond Weekend horse-racing”,

• (b) at the end insert—

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations amend the Health Protection (Coronavirus, International Travel) (England) Regulations 2020 (“the International Travel Regulations”).

They amend regulation 4 of the International Travel Regulations to provide that a person who is required to be in self-isolation is not required to isolate themselves from a visitor to the place where they are self-isolating if the visitor is there to provide certain services including care and medical assistance. They amend Schedule 2 to remove the exemption from the requirement to self-isolate for certain health or care professionals, and they amend the list of specified competitions in Schedule 3 (which is relevant to the exemption from the requirement to self-isolate for elite sportspersons). They also make a number of minor amendments.
