The Civil Enforcement of Parking Contraventions Designation (No. 2) Order 2020

Made: 2nd September 2020

Laid before Parliament: 8th September 2020

Coming into force: 29th September 2020

Accordingly, the Secretary of State[^f00002] makes this Order.

Citation and commencement

This Order may be cited as the Civil Enforcement of Parking Contraventions Designation (No. 2) Order 2020 and comes into force on 29th September 2020.

Interpretation

In this Order—

• “grid reference” means Ordnance Survey National Grid reference point; and

• “strategic road network” means the highways for which Highways England Company Limited[^f00003] is the highway authority by virtue of the Appointment of a Strategic Highways Company Order 2015[^f00004].

Designation of civil enforcement area and special enforcement area

• (1) The Secretary of State designates each of the areas mentioned in paragraph (2) as—

• (a) a civil enforcement area for parking contraventions; and

• (b) a special enforcement area.

• (2) The areas are—

• (a) in the area of Hampshire County Council, the whole of the area of Gosport Borough Council;

• (b) in the area of East Sussex County Council, the whole of the area of the District of Rother;

• (c) the part of the area of the Council of the City of Stoke-on-Trent specified in Schedule 1; and

• (d) the part of the area of Surrey County Council specified in Schedule 2.

Revocation

The following Orders are revoked—

• (a) the Road Traffic (Permitted Parking Area and Special Parking Area) (City of Stoke-on-Trent) Order 2001[^f00005];

• (b) the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Surrey) (District of Mole Valley) Order 2004[^f00006];

• (c) the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Surrey) (Borough of Guildford) Order 2004[^f00007];

• (d) the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Surrey) (Borough of Reigate and Banstead) Order 2004[^f00008];

• (e) the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Surrey) (Borough of Runnymede) Order 2004[^f00009];

• (f) the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Surrey) (Borough of Epsom and Ewell) Order 2005[^f00010];

• (g) the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Surrey) (Borough of Spelthorne) Order 2005[^f00011];

• (h) the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Surrey) (Borough of Woking) Order 2005[^f00012];

• (i) the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Surrey) (Borough of Elmbridge) Order 2005[^f00013];

• (j) the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Surrey) (Borough of Surrey Heath) Order 2006[^f00014];

• (k) the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Surrey) (District of Tandridge) Order 2006[^f00015]; and

• (l) the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Surrey) (Borough of Waverley) Order 2007[^f00016].

SCHEDULE 1 — The part of the area of the Council of the City of Stoke-on-Trent designated as a civil enforcement area for parking contraventions and special enforcement area

The whole of the area of the Council of the City of Stoke-on-Trent except—

• (a) the A50 for the whole of its length within the City from grid reference SJ8784643700 to SJ9441241467, excluding its associated slip roads; and

• (b) the A500 for the whole of its length within the City from grid reference SJ8640846909 to SJ8593242391, excluding its associated slip roads.

SCHEDULE 2 — The part of the area of Surrey County Council designated as a civil enforcement area for parking contraventions and special enforcement area

The whole of the area of Surrey County Council except—

• (a) the roads forming the parts of the strategic road network listed in paragraph 2; and

• (b) the roads owned by, or under the control of, the Secretary of State for Defence listed in paragraph 3.

• (1) The M3 motorway and its associated slip roads for the whole of its length within the County from grid reference TQ103703 to the boundary with the area of Hampshire County Council at grid reference SU866581.

• (5) The M23 motorway and its associated slip roads for the whole of its length within the County from the boundary with the area of West Sussex County Council at grid reference TQ305416 to its merging points with the A23 near the northern boundary of the County at grid reference TQ289545.

EXPLANATORY NOTE

This Order designates part of the area of each of Hampshire County Council, East Sussex County Council, the Council of the City of Stoke-on-Trent and Surrey County Council as a civil enforcement area for parking contraventions, and as a special enforcement area, for the purposes of Part 6 of the Traffic Management Act 2004.

An impact assessment has not been produced as no impact on the private or voluntary sectors is foreseen. An Explanatory Memorandum is available alongside the instrument on www.legislation.gov.uk .
