Coming into force in accordance with regulation 1

For the purposes of Article 11(1) of the Framework Regulation, the Secretary of State considers that the conditions set out in Article 11(1)(a) to (d) are satisfied. The Secretary of State has complied with Article 11(2) of that Regulation.

In regulations 1 and 6, “Commission Delegated Regulation (EU) 2019/2016” means Commission Delegated Regulation (EU) 2019/2016 of 11 March 2019 supplementing Regulation (EU) 2017/1369 of the European Parliament and of the Council with regard to energy labelling of refrigerating appliances and repealing Commission Delegated Regulation (EU) No 1060/2010[^f00004], as modified by Schedule 3 to the Ecodesign for Energy-Related Products and Energy Information (Amendment) (EU Exit) Regulations 2020[^f00005].

— (a) the information set out in point 3.4 of Annex 2; and (b) the details and results of the calculations carried out in accordance with— (i) where applicable, point 2 of Annex 2; and (ii) Annex 3 (measurements and calculations).

(1) The Secretary of State must, before 25th December 2024— (a) evaluate this Regulation, taking into account the speed of technological progress; and (b) publish a report stating whether or not in their opinion this Regulation should be amended. (2) If the Secretary of State concludes under paragraph (1) that this Regulation should not be amended, the Secretary of State must review this conclusion from time to time and publish a new report under paragraph (1)(b) at intervals not exceeding 5 years.

(36) ‘declared values’ means the values provided by the manufacturer, importer or authorised representative in the technical documentation in accordance with point 3.4 of Annex 2, for the verification of conformity by the market surveillance authority[^f00008].

The verification tolerances set out in this Annex relate only to the verification by the market surveillance authority of the declared values. The manufacturer, importer or authorised representative of a product must not use the verification tolerances— (a) to establish the declared values; (b) to interpret the declared values; or (c) to communicate better performance.

; and (d) the manufacturer, importer or authorised representative has complied with the information requirements in point 3.1 of Annex 2 (servers) or, as the case may be, point 3.2 of Annex 2 (data storage products); and (e) when the market surveillance authority checks the unit of the model, the unit complies with the resource efficiency requirements in point 3.3 of Annex 2.

(b) the information set out in table 4 of Annex 5 (product information sheet) is made available on a publicly accessible website;

(29) ‘declared values’ means the values provided by the supplier in the technical documentation in accordance with point (4) of Annex 6 for the verification of conformity by the market surveillance authority; (30) ‘guarantee’ means any undertaking by the dealer or the supplier to the consumer that, if an electronic display does not meet the specifications set out in the guarantee statement or in any associated advertising— (a) the consumer will be reimbursed for the price paid for the electronic display; or (b) the electronic display will be repaired, replaced or handled in any way.

For the purposes of the EEI calculation, the declared values of the following technical parameters listed in Table 5 of Annex 6 (technical documentation) must be used— (a) on mode power demand (Pmeasured ); (b) visible screen area.

(g) If the electronic display does not support HDR— (i) the following must not be displayed— (aa) the HDR pictogram; and (bb) the energy efficiency class; and (ii) the screen pictogram, indicating screen size and resolution, must be vertically centred in the area below the indication of the energy consumption.

(3) The following items in Table 4 are not relevant for the purposes of determining whether a model is an equivalent model under Article 2(6) of the Framework Regulation— (a) supplier’s name or trade mark; (b) supplier’s address; (c) model identifier; (d) minimum guaranteed availability of software and firmware updates; (e) minimum guaranteed availability of spare parts; (f) minimum guaranteed product support; (g) minimum duration of the guarantee given by the supplier.

(1) a general description of the model, sufficient for it to be unequivocally and easily identified; (2) references to the designated standards applied or other measurement standards used; (3) specific precautions that must be taken when the model is assembled, installed, maintained or tested; (4) the values of the technical parameters set out in Table 5; (5) the details and the results of the calculations performed in accordance with Annex 4; (5A) the conditions of testing that must be applied, if not fully described in the information provided under point (2); (5B) the identifier of all equivalent models already placed on the market;

The verification tolerances set out in this Annex relate only to the verification by the market surveillance authority of the declared values. The supplier of a product must not use the verification tolerances— (a) as allowed tolerances to establish the declared values; (b) to interpret the declared values; or (c) to communicate better performance. The values and classes published on the label or in the product information sheet must not be more favourable to the supplier than the declared values.

(i) in the case of the determined values of the ABC luminance-related parameters (see rows 36 to 39 of Table 5 of Annex 6), the requirements in point (e) of point C of Annex 2; and (ii) otherwise, the respective verification tolerances set out in Table 6.

(3) The model and all equivalent models must be considered not to comply with this Regulation if— (a) the result referred to in point 2(a), (b) or (c)(i) is not achieved; or (b) the determined value of a parameter listed in rows 3 to 5 or 7 to 10 of Table 6 does not comply with the applicable verification tolerance set out in Table 6.

Parameter Verification tolerances
1. On mode power demand, (Pmeasured, Watts) The determined value must not exceed the declared value by more than 7 %.
2. Off mode, standby mode and networked standby mode power demand (Watts), as applicable The determined valuemust not exceed the declared value by more than 0.10 Watt if the declared value is 1.00 W or less, or by more than 10% if the declared value is more than 1.00 W.
3. Visible screen area The determined value must not be lower than the declared value by more than whichever is the smaller of 1 % or 0.1 dm².
4. Visible screen diagonal in centimetres The determined valuemust not differ from the declared value by more than 1cm.
5. The screen resolution in horizontal and vertical pixels The determined value must not differ from the declared value.
6. Peak white luminance The determined valuemust not be lower than the declared value by more than 8%.
7. Length of time in on mode before the electronic display automatically switches to standby, off mode or another condition which does not exceed the applicable power demand requirements for off mode or standby mode The determined value must not exceed the declared value by more than 5 seconds.
8. Amendments to Commission Delegated Regulation (EU) 2019/2014: household washing machines and washer-dryers

(b) the information set out in Table 5 of Annex 5 (product information sheet for household washing machines) or, as the case may be, Table 6 of Annex 5 (product information sheet for household washer-dryers) is made available on a publicly accessible website;

(33) ‘declared values’ means the values provided by the supplier in the technical documentation in accordance with point 1(d) of Annex 6 (household washing machines) or point 2(d) of Annex 6 (household washer-dryers) for the verification of conformity by the market surveillance authority; (34) ‘wash and dry cycle’ means a complete cycle for cotton laundry— (a) which is continuous if the household washer-dryer provides a continuous cycle; (b) where the washing cycle is the eco 40-60 programme; and (c) where the drying cycle achieves cupboard dry status.

Where a calculation in this Annex uses a parameter listed in Table 7 of Annex 6 (technical documentation for household washing machines) or Table 8 of Annex 6 (technical documentation for household washer-dryers), the supplier must use the declared value for that parameter.

For household washing machines with a rated capacity higher than 3 kg and for the washing cycle of household washer-dryers with a rated washing capacity higher than 3 kg, the value to be entered on the Product Information sheet for IW is the lowest of the values for— (a) the washing efficiency index at the rated washing capacity; (b) the washing efficiency index at half of the rated washing capacity; and (c) the washing efficiency index at quarter of the rated washing capacity. For household washing machines with a rated capacity lower than or equal to 3 kg and for the washing cycle of household washer-dryers with a rated capacity lower than or equal to 3 kg, the value to be entered on the Product Information Sheet for IW is the value for the washing efficiency index at the rated washing capacity. For household washer-dryers with a rated capacity higher than 3 kg, the value to be entered on the Product Information sheet for JW is the lower of the values for— (a) the washing efficiency index at the rated capacity; and (b) the washing efficiency index at half of the rated capacity. For household washer-dryers with a rated capacity lower than or equal to 3 kg, the value to be entered on the Product Information Sheet for JW is the value for the washing efficiency index at the rated capacity.

For household washing machines with a rated capacity higher than 3 kg and for the washing cycle of household washer-dryers with a rated capacity higher than 3 kg, the value to be entered on the Product Information Sheet for the IR is the highest of the values for— (a) the rinsing effectiveness at rated washing capacity; (b) the rinsing effectiveness at half of the rated washing capacity; and (c) the rinsing effectiveness at quarter of the rated washing capacity. For household washing machines with a rated capacity lower than or equal to 3 kg and for the washing cycle of household washer-dryers with a rated capacity lower than or equal to 3 kg, no value is to be entered on the Product Information Sheet for IR. For household washer-dryers with a rated capacity higher than 3 kg, the value to be entered on the Product Information Sheet for JR is the higher of the values for— (a) the rinsing effectiveness index at the rated capacity; and (b) the rinsing effectiveness index at half of the rated capacity. For household washer-dryers with a rated capacity lower than or equal to 3 kg, no value is to be indicated on the Product Information sheet for JR.

(11) The spin speed of a household washing machine and of the washing cycle of a household washer-dryer must be measured or calculated at the highest spin speed option for the eco 40-60 programme and rounded to the nearest integer.

(b) the information set out in Table 6 of Annex 5 (product information sheet) is made available on a publicly accessible website;

(42) ‘declared values’ means the values provided by the supplier in the technical documentation in accordance with point 1(d) of Annex 6 for the verification of conformity by the market surveillance authority.

Where a calculation in this Annex uses a parameter listed in Table 7 of Annex 6 (technical documentation), the supplier must use the declared value for that parameter.

(h) the freezing capacity of a compartment must be calculated at 24 times the light load weight of that compartment, divided by the freezing time to bring the temperature of the light load from +25 to -18 °C at an ambient temperature of 25 °C, expressed in kg/24 hr and rounded to one decimal place;

(i) for 4-star compartments, the freezing time to bring the temperature of the light load from +25 to -18 °C at an ambient temperature of 25 °C must be such that the resulting freezing capacity complies with the requirement in point (4) of Annex 1 (definition of ‘freezing capacity’);

(k) the light load weight for a 4-star compartment must be calculated at 3.5 kg per 100 litres of the volume of the 4-star compartment, rounded up to the nearest 0.5 kg, except that it must be deemed to be 2 kg if that calculation results in a value lower than 2 kg; (l) if the refrigerating appliance includes a combination of 3-star and 4-star compartments, the sum of the light load weights must be calculated at 3.5 kg per 100 litres of the total volume of all 4-star and 3-star compartments, rounded up to the nearest 0.5 kg, except that it must be deemed to be 2 kg if that calculation results in a value lower than 2 kg.

(4) Where applicable, the power consumption of the off mode (Po), standby mode (Psm) and delay start (Pds) must be measured.
