The Countryside Stewardship (England) (Amendment) Regulations 2021

The Secretary of State makes these Regulations, with the consent of Treasury, in exercise of the powers conferred by section 98 of the Environment Act 1995[^f00001].

Citation, commencement, extent and application

• (1) These Regulations may be cited as the Countryside Stewardship (England) (Amendment) Regulations 2021 and come into force on 8th February 2021.

• (2) These Regulations extend to England and Wales but apply to England only.

Amendments to the Countryside Stewardship (England) Regulations 2020

• (1) The Countryside Stewardship (England) Regulations 2020[^f00002] are amended as follows.

• (2) In regulation 5(3)—

• (a) after “agreement” insert “only”;

• (b) for “any” substitute “an”.

• (3) Omit regulations 14, 16(6)(b) and 16(8).

• (4) In regulation 15, omit the words from “, together with” to “regulation 14,”.

• (5) In the Schedule—

• (a) in Part 2, in the table—

• (i) under the heading “8. Uplands”, after the entry “(f) Upland livestock exclusion supplement” insert—

• (ii) under the heading “9. Woodland and scrub”, in the entry “(f) Creation of wood pasture”, in the second column, after “new” insert “lowland”;

• (b) in Part 3, in the table—

• (i) under the heading “4. Fencing and gates”, after the entry “(j) Deer exclosure plot” insert—

• (ii) for the heading “4. Forestry” substitute “4A. Forestry”;

• (iii) under the heading “9. Soil and water”—

• (aa) in the entry “(ac) Self-supporting covers for slurry stores”, in the first two columns, after “slurry” insert “and anaerobic digestate”;

• (bb) in the entry “(ad) Floating covers for slurry stores and lagoons”, in the first two columns, after “slurry” insert “and anaerobic digestate”;

• (iv) under the heading “12. Wildlife boxes”, after the entry “(c) Large wildlife box” insert—

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations, which apply to England only, are made pursuant to section 98 of the Environment Act 1995.

Regulation 2 makes amendments to the Countryside Stewardship (England) Regulations 2020. Paragraph (2) prohibits the transfer of capital-only countryside stewardship agreements. Paragraphs (3) and (4) omit regulations that grant the Secretary of State powers to charge interest on recoveries and a fee for appeals. Paragraph (5) adds new activities that are eligible for funding.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sector is foreseen.
