Coming into force in accordance with article 1

The Secretary of State for Transport, makes this Instrument in exercise of the powers conferred by section 106(3) of the Highways Act 1980[^f00001], and now vested in the Secretary of State[^f00002]:

This Instrument may be cited as “The Sunderland City Council (Riverside Sunderland – New River Wear High Level Footbridge) Scheme 2020 Confirmation Instrument 2021” and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

The Sunderland City Council (Riverside Sunderland – New River Wear High Level Footbridge) Scheme 2020 (“the Scheme”) is hereby confirmed.

The Scheme as confirmed is set out in the Schedule (including the plan) and copies of the Scheme with its accompanying plan are deposited at the offices of the Department for Transport, MHCLG, 1 Priory Square, Priory Street, Hastings, East Sussex, TN34 1EA and at the offices of Sunderland City Council at the Civic Centre, Burdon Road, Sunderland SR2 7SN.

THE SCHEDULE — THE SUNDERLAND CITY COUNCIL (RIVERSIDE SUNDERLAND – NEW RIVER WEAR HIGH LEVEL FOOTBRIDGE) SCHEME 2020

The Sunderland City Council (“the Council”) make this Scheme in exercise of their powers under section 106(3) of the Highways Act 1980 and all other powers enabling them in that behalf.

1 The Council are authorised to construct over the navigable waters of the River Wear the Footbridge specified in the Schedule to this Scheme required as part of the development of the Riverside and which is required to connect for pedestrian and cycleway purposes only the Vaux Site and the Sheepfolds area situate in the city centre of Sunderland.

2 This Scheme may be cited as The Sunderland City Council (Riverside Sunderland – New River Wear High Level Footbridge) Scheme 2020.

EXPLANATORY NOTE

This instrument confirms a Scheme to construct over the navigable waters of the River Wear the Footbridge specified in the Schedule to this Scheme required as part of the development of the Riverside and which is required to connect pedestrian and cycleway purposes only the Vaux Site and the Sheepfolds area situated in the city centre of Sunderland.

The Secretary of State has modified this Bridge Scheme as follows:

1 In the Schedule to the Scheme, the paragraph titled ‘PLANS AND SPECIFICATIONS OF THE NEW RIVER WEAR HIGH LEVEL FOOTBRIDGE’, the plan numbered SCC-NWF-ATK-SBR-XX-DR-000001’ has been amended to SCC-NWF-ATK-SBR-XX-DR-S-000001.

2 In the Schedule to the Scheme, the paragraph titled POINTS OF COMMENCEMENT AND TERMINATION, the word ‘approximately’ has been removed from both sentences.
