The Secretary of State makes the following Regulations in exercise of the powers conferred by section 186(6) and (7) of the Health and Care Act 2022[^f00001].

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations bring into force specified provisions of the Health and Care Act 2022 (c. 31) (“the Act”) on 1st October 2022 (regulation 2) and on 1st November 2022 (regulation 3). They are the third set of commencement regulations to be made under the Act.

Regulation 2(a) brings into force on 1st October 2022 section 97 (general duties of Health and Social Care Information Centre etc) of the Act.

Regulation 2(b) brings into force on 1st October 2022 section 99 (collection of information about adult social care) of the Act in so far as it inserts section 277A(6) into the Health and Social Care Act 2012 (c. 7) (“the 2012 Act”).

Regulation 2(c) brings into force on 1st October 2022 section 100 (enforcement of duties against private providers) of the Act.

Regulation 2(d) brings into force on 1st October 2022 section 177 (review into disputes relating to treatment of critically ill children) of the Act.

The provisions being commenced by regulation 2(b) and (c) of these Regulations relate to the enforcement of requests for information from the Secretary of State under section 277A(1) to (5) of the 2012 Act, which were inserted by section 99 of the Act when that section was commenced by the Health and Care Act 2022 (Commencement No. 2 and Transitional and Saving Provision) Regulations 2022 (S.I. 2022/734) (C. 45) on 31st July 2022.

Regulation 3 brings into force on 1st November 2022 sections 175 (fluoridation of water supplies) and 176 (fluoridation of water supplies: transitional provision) of the Act in so far as they relate to water supplied to areas in England.
