The Common Organisation of the Markets in Agricultural Products (Third Country Listing for Fruit and Vegetables) (Amendment, etc.) Regulations 2022

The Secretary of State has consulted such bodies and persons as appear to the Secretary of State to be representative of the interests likely to be substantially affected by the Regulations and such other bodies and persons as the Secretary of State considers appropriate in accordance with Article A149(4) of that Regulation.

PART 1

Citation, commencement and interpretation

• (1) These Regulations may be cited as the Common Organisation of the Markets in Agricultural Products (Third Country Listing for Fruit and Vegetables) (Amendment, etc.) Regulations 2022.

• (2) These Regulations come into force on 1st July 2022.

• (3) In these Regulations, “Commission Implementing Regulation (EU) No 543/2011” means Commission Implementing Regulation (EU) No 543/2011 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 in respect of the fruit and vegetables and processed fruit and vegetables sectors.

PART 2

Approval of conformity checks by certain EU member states under Article 15 of Commission Implementing Regulation (EU) No 543/2011

• (1) The checks on conformity to marketing standards for fruit and vegetables carried out by the states listed in column 1 of the table set out in the Schedule prior to import into Great Britain are approved in accordance with Article 15(1) of Commission Implementing Regulation (EU) No 543/2011.

• (2) In accordance with Article 15(2) of Commission Implementing Regulation (EU) No 543/2011, in respect of each state listed in column 1 of the table set out in the Schedule—

• (a) the official authority, under the responsibility of which the checks referred to in paragraph (1) are carried out, is the body listed in the corresponding entry in column 2;

• (b) the inspection bodies in charge of the checks referred to in paragraph (1) are those bodies listed in the corresponding entry in column 3.

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations are made in exercise of the powers conferred by Articles 15(1) and A149 of Commission Implementing Regulation (EU) No 543/2011 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 in respect of the fruit and vegetables and processed fruit and vegetables sectors (EUR 2011/543).

Part 2 of these Regulations approves checks on conformity to marketing standards, carried out by authorities of certain European Union Member States listed in the Schedule, on fruit and vegetables prior to import into Great Britain.

In Part 3, regulation 3 amends the table in Annex 4 to Commission Implementing Regulation (EU) No 543/2011 to include the European Union Member States listed as third countries for which marketing standards conformity checks on fruit and vegetables prior to import into Great Britain are approved.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
