The Traffic Management Act 2004 (Commencement No. 11) (England) Order 2022

The Secretary of State for Transport makes this Order in exercise of the powers conferred by section 99(1) and (2) of the Traffic Management Act 2004[^f00001].

Citation and extent

• (1) This Order may be cited as the Traffic Management Act 2004 (Commencement No. 11) (England) Order 2022.

• (2) This Order extends to England and Wales.

Commencement of provision

Section 58(2) (inspection fees) of the Traffic Management Act 2004, except for the words “, or pay the prescribed fee,” in the substituted paragraph (6) of section 75 (inspection fees) of the New Roads and Street Works Act 1991[^f00002], comes into force as respects England on 17th June 2022.

Explanatory note

EXPLANATORY NOTE

This Order brings into force section 58(2) of the Traffic Management Act 2004 (c. 18) (apart from certain words in paragraph (6) of the substituted section), on 17th June 2022.

Section 58(2) substitutes section 75 of the New Roads and Street Works Act 1991 (c. 22) to allow inspection fees regulations made under that section to make different provision according to an undertaker’s previous performance and to prescribe how, and over what period, an undertaker’s previous performance will be assessed.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
