The Health and Care Act 2022 (Commencement No. 7) Regulations 2023

Made: 20th September 2023

The Secretary of State makes these Regulations in exercise of the powers conferred by section 186(6) and (7) of the Health and Care Act 2022[^f00001].

Citation and extent

• (1) These Regulations may be cited as the Health and Care Act 2022 (Commencement No. 7) Regulations 2023.

• (2) These Regulations extend to England and Wales.

Provisions coming into force on 1st October 2023

The following provisions of the Health and Care Act 2022[^f00002] come into force on 1st October 2023—

• (a) sections 109 to 135 (the HSSIB);

• (b) section 169 (medical examiners), except subsection (5);

• (c) Schedules 13 to 15 (the HSSIB; exceptions to the prohibition on disclosure of HSSIB material; consequential amendments relating to the HSSIB).

Explanatory note

(This note is not part of the Regulations)

Explanatory Note

These Regulations bring into force specified provisions of the Health and Care Act 2022 (c. 31) (“the Act”) on 1st October 2023. They are the seventh set of commencement regulations to be made under the Act.

Regulation 2 commences provisions which establish the Health Services Safety Investigations Body and certain provisions in relation to medical examiners. Section 169(5) of the Act has not been commenced because it amends a definition which is yet to be inserted into section 41(1) of the Births and Deaths Registration Act 1953 (c. 20); that insertion will be made once the relevant part of paragraph 21(1) of Schedule 21 to the Coroners and Justice Act 2009 (c. 25) is commenced.
